I was the victim of an attempted illegal debt collection by Arrow; I received a notice from them stating that I had a delinquent account in collections. When I called them and asked for details they claimed that I had failed to abide by terms of a contract I had signed with a health club. Not only had I never heard of the particular health club but the debt was 14 years old - well beyond the statute of limitations. I informed the representative of this and he claimed he wasn't aware of any law regarding a statute of limitations. I told him that unless and until they win a judgement against me in a court of competent jurisdiction they would receive absolutely no money, that if they did sue me they would be countersued and that they were not to contact me in any way unless it involved the delivery of a legitimate subpoena. I also informed him that if any agents showed up to attempt to collect the "debt" that they would be arrested for malicious harassment and, if applicable, criminal trespassing. I also stated that if they were in possession of any firearms during these actions, as private investigators tacitly impersonating police officers tend to be, that they would be arrested for possession of a firearm during the commission of a crime. I haven't heard from them since because, undoubtedly, they're aware of the fact that I know my rights and am willing to go to the mat to exercise them. That is the best way to handle crooks like these; let them know that you know the law.

Send them a cease and desist letter advising them not to call you at work. Send it to the physical street address. The Budd Hibbs site has a list of the collection agencies. Just do a search for Budd Hibbs. If the debt is past the statute of limitations for your state, they cannot legally sue you. In order to get your wages, your house or any of your property, they have to sue you first and get a judgment. If the debt is past the statute of limitations for your state, the only thing that they can do is harass you until it is paid. If they violate the cease and desist letter for work, log all violations and sue them. Send a letter of complaint to the FTC, the AG of your state, the BBB and anyone else you can think of. ALso make sure that you send copies of your complaints of their violations to these agencies to them certified mail, return reciept requested. These folk do not obey the law.
