I filed a complaint through the Better Business Bureau about an illegally reaged debt I discovered on our credit report. Here is the rediculous response I got:

"The company would like to states that they are not nor have they ever reported any false information. The company also states that it is the policy of the company to furnish info to the consumer reporting agencies pursuant to the Metro II guidelines. The company states that if the consumer has anything to the contrary the company is asking that they provide a copy of their credit report, so they may assist them further."

Send a copy of my credit report???? You can't be serious!

I replied with a request for validation materials to which I received the exact same response word for word...

I have already reported the initial discovery to the state Attorney General and the FTC. I'm going to be contacting all 3 major CRAs with a copy of this garbage.

If the company is a dues paying member - BBB accepts any response as resolution, in spite of the fact that it was not resolved. www.budhibbs.com - A consumer advocate website that specializes in Debt Collection and these bottomfeeders are listed as an agency to avoid - BECAUSE THEY VIOLATE FDCPA AND FRCA REGULARLY! Collection agencies and their patys's that frequent this board do not like it when we refer you to this website - because it exposes all the illegal tricks agencies like Asset Acceptance uses to collect debts illegally http://www.budhibbs.com/debtcollectorpages/asset_acceptance_corp.htm

Carrie. FORGET THE BBB!! They CANNOT do anything for you, and they have no legal authority to do anything. Using them is a waste of time, AND the collection agency is LAUGHING HARD that you would even use the BBB as they know they are a joke. The ONLY way to enforce your rights under the FDCPA and/or the FCRA is in writing and should be sent via certified mail, return reciept requested. Be sure to put the certified# on the letter itself, and keep a copy for your records. This way, you can prove excatly what you sent, as well as who recieved it and when. They have 30 days from that date to prove the item in dispute. If the CA fails to comply with your debt validation request, they must at that time cease all collections actions. The CB must validate or remove the entry. Your ONLY enforcement UNDER THE LAW is in the courtroom. If you are not willing to do that, you will lose.
