My home will soon be in foreclosure through Aurora Loan Company.

Aurora Loan Company has called me many times to seek permission to use my escrow account (tax, insurance)payments towards my mortgage.

They are requesting I provide written permission for them to do so, but have failed to provide me with anything in writing themselves regarding this agreement.

This is a $233,000 loan and am astounded in their vagueness and unprofessionalism. I cannot get any real answers from Aurora Loan Services.

My loan is currently under investigation for mortgage fraud. Does anyone know: If my home forecloses, will I still have a leg to stand on for my mortgage fraud case? Should I authorize Aurora Loan Company to use my escrow funds towards my mortgage to buy me more time? Am I authorized to have the escrow funds returned to myself (even if the loan is not current)?

I appreciate all the responses on Aurora Loan Company,it's made me think twice before proceeding further with them so quickly.

The only way they can use money from your escrow acocunt is if there is an overage. You should have been notified by mail of this overage. Anytime your account is deliquent the overage will not be returned to you until the loan is brought current. The only way the escrow overage can be used is if you authorize it in writing. Servicesr are required to maintain an escrow balance to pay the taxes and insurance, so if they are asking you to apply money from escrow, it is an overage. Call and request a copy of the letter that was sent advising you of the overage and then send the written request to apply the money.
