I took a loan out from Autloans LLC in October of 2014. I was in a bad spot, I needed the money or I would be evicted. Due to my divorce I already was behind in bills and had just been hit with a garnishment on my paycheck. A title loan seemed like the only option. It was the worst decision of my life. I knew I would pay a lot for this decision, but didn't see any other options. Little did I know i would pay this much. 

 

My loan was for 4500. I had a monthly payment of $680. I paid on it monthly via direct withdrawl. I continued to struggle with my finances, and paid every month from November through May. In May I missed a payment and and filed Chapter 13 bankruptcy. I listed Autoloans LLC as a creditor on my filing and listed the address that I had sent the paperwork to for my loan, as the address of the creditor. On May 14th I officially filed for bankruptcy with every intent to restructure my debt and pay my debts. 

 

On June 1st 2015 my Jeep was repossesed by Autloans LLC. I immediately notified them via email that I had filed for bankruptcy. I called them the next morning and also informed them verbally that I had filed for bankruptcy and was told that I needed to speak to John, but that he was out and to call back the next day. I left a voice mail. I did not receive a response. 

 

On June 3rd I again called them and was told John was out. On June 4th I again called and was told that John was out again. I asked if anyone could handle my case and was told no. I called again on June 5th and was told John was still out due to a family emergency, but that he was checking messages and returning calls. I left a message again, and again, did not receive a response. 

 

On June 8th I again called and was told John ould not be back until the next day. That he had missed his flight. I again asked if anyone else could handle my case and was told no. 

 

June 9th I went to court for my 341 hearing. During my hearing I mentioned this to my lawyer and my bankruptcy trustee. Both said this action was illegal and that there was action that could be taken. 

 

June 11th I again called trying to get ahold of John. I was told he was in a meeting util 3PM. I called back at 3:05 and was told he was on the phone. I called back 15 minutes later and was told he was still on the phone but would call me before end of day. I called 20 minutes later and was told he was in a meeting. 

 

I then called my lawyer and asked for assistance. They quickly acted and called Autoloans, LLC. Surprise suprise! Sudenly John was available. He told my lawyer that he needed to check and see if they still had my vehicle and that he would get back to them. I had not known about this conversation so I called Autloans LLC and suddenly John was available. 

 

John told me they never received the notice from the court about my bankruptcy. He also told me that had they received the notice they never would have repossessed my vehicle, "especially because it is a Chapter 13". While on the phone he aknowledged receipt of the notice from my lawyer. He told me that it looked lik my car had been sold June 2nd, less than 24 hours after it had been repossessed! He told me he would get in touch with his liquidation department and let me know if they still had my vehicle. He promised to call me the next morning. 

 

The next day John never called. I called him and was told that he was "uhh... yeah he's on the phone" I told them I would hold. Eventually John answered and he told me that he was pretty sure they had sold my car and that they no longer had it. He said he was sorry, but my vehicle was gone. I then asked him how this could happen? Per both Washington state law and Florida state law that I had to be notified my vehicle was being sold. 

 

This is when John told me that they are not a Florida company, that they are instead a Cook Island company and the laws of the US did not apply. He also told me that the notification requirements did not apply because it was a pawn, not a loan as it had been originally explained. He told me again that there was no chance I was getting my vehicle back. He told me that he was still checking wih his liquidation department but ws sure it was gone. I asked when he would know, he had told me "in the morning" the day before. He told me it was still morning and promised to get ahold of me by end of day. This did not happen. 

 

I called again that afternoon. John was again not available. I again held, only this time when the phone finally rang for his extension I was hung up on. I immediately called back and was told that John had left the office. 

 

I was lied to. My vehicle was illegally repossessed by a business who does not have legal auhority to do business in Washington state. My vehicle was basically stolen from me by a company who feels they do not need to adhere to the law because they have a shadown corporation set up in the Cook Islands, even though they have offices in Florida and Nevada, and do business nation wide via the internet. I was prayed upon and am now paying the price wihout anyone seemingly able to help.

 Why didn't I notify my attorney sooner? Sorry for not stating thus earlier. I did notify my attorney on the 2nd and we spoke on the 4th, and again on the 9tb. Why isn't my attorney doing more? This is a valid question, and one I am constantly thinking about as well. My attorney hasn't stolen my vehicle though, and my attorney is licensed to do business in Washington. 2 things that can't be said about autoloans llc. Why am I still trying to contact autoloans plc? Because I want my vehicle back and an willing to do whatever it takes to get it back. Shouldn't my attorney be handling all of this? Perhaps, but that doesn't mean I won't do everything I can to get it back. Hopefully this answers your questions about me and my attorney, and hopefully we can now resume discussing autoloans llc and their predatory, immoral, and illegal business practices.

If you filed Bankruptcy on May 14th, and your car was reposessed on June 1st.  Why did it take you until June 9th to talk to your attorney?

At that time they say that action could be taken.  So why didn't they then?  As two days later YOU are still trying to contact them.  When you finally talked to your attorney again.  This time your attorney "jumped right on it" and made a call.  Yet right after that it was once again YOU calling them.

So even though it may have taken you longer to notify your attorney, why once your attorney(and the courts)were notified does it appear that you are still doing all of this work?  Isn't that what your attorney gets paid for? Wouldn't the court have taken action?
