I received  a PO from Auxo Medical  (Clay Morris) for a used Amsco 2010  Eagle sterilizer.  I sent photos and ask if there was any additional information I could get for them. They responded with no everything looks ok. They sent a PO and  sent a freight company in  to pick up the equipment. Once on there dock they refused to pay , saying it had no boiler tag. I do know when you use a sterilizer for parts and or rebuild the sterilizer you will need to get a new certification for the instrument. This is the law. They said I was wrong and said they will not pay the PO. This equipment was sold as a parts machine only. The PO was for only 2,000 US. Rebuild, the equipment and it would be worth mid to high twenties. Once I new they would not pay  I sold the equipment again to Steris company. They sent a truck in to pick up the equipment. They would not let it be pick up  by the trucking company. They stated that they have freight charges on the equipment. I offered to pay half , and they said no. It is clear they wanted the equipment , but did not want to pay for the equipment. And so far they have not payed.

This case has already been arbitrated by the BBB as stated in an earlier post.  It was found the Mr. D**** did not supply what was ordered, that his statements were not accurate, but that Auxo should have done more due diligence when dealing with him, and been more specific with its purchase order.  As such, Auxo Medical could not recoup the freight it spent on, but Auxo was also not required to pay for the sterilizer.

Per the findings of the arbitrator, Mr. D**** was given 60 days to pick up the sterilizer.  After that time he would lose the rights to it.  He failed to do this, despite his assertion that the sterilizer was worth many thousands of dollars.  Obviously it was not worth what he claimed, or he would have picked it up.  

Since this issue has been resolved by means of binding arbitration, no bottom feeding attorneys or collection companies need to worry themselves about this issue.

The issue Mr Dotson referred to was arbitrated by the Better Business Bureau in January.  The arbitrator found that the facts Mr. Dotson claims were false.  He did find that Auxo bought a "Pig in a Poke" (the arbitrator's words) and we should have been more careful in dealing with Mr Dotson.  As such, Auxo could not recoup the freight charge it incurred, but that Mr. Dotson was also not entitled to be paid for the sterilizer he delivered since it was lacking a boiler tag.

My advice is that if you deal with Mr. Dotson in the future, be very detailed in what you expect, because he was clearly misinformed about sterilizers.
