A contract was signed on Apr 23,2007 for building of wood deck with arbour and leveling of home. (11,500.00)
Work was carried out over 3 month period. Towards the end of the 3 month period contractor (Brian Miller) asked if i wanted a stucco skirting around deck that wasn't in the original contract. I asked how much was the price. He gave me a figure verbally around 1200.00.
At that point is said no don't do it i want to stay with the orginal contract and within my budget. The next day after i came home from work i noticed Brian Miller was close to finishing the stucco around the deck.
I reminded him what i said the day before. He stated that he dosen't like to leave his jobs not completely finished and decided to do it anyway. He also stated i didn't have to pay him but it would be nice if i at least paid his materials. I said ok if it was reasonable.
A few days later when the work was complete he hands me a bill for $3000.00 extra.
I said that's kind of high for just materials for the stucco/2"x2" wood sticks on top of the arbour isn't it. He said no,that's what I want.
Since that point he has been calling every 1 to two weeks demanding money.
I have not only paid the original contract amount but an additional $2500.00.
I think i have been more than fair. And i believe he is not. I have asked him to justify the additional amount. He stated "We are beyond that point" and refused.
On Jan 11,2008 i received a nasty / threating call at work from Brian Miller stating he will put a lean on my house.
Since there is no contract to this extra work that i also did not authorize,Brian Miller said he will use the memo part of a check my wife wrote him (part of the $2500.00)to put a lean on my house.
Since he finished the work,i have noticed several more vertical cracks on the interior walls of my house(Upstairs and downstairs) that where never there since i bought this house in 1999.
There is also separation of drywall taping on ceilings all over the house. Many doors will not close.
I also filed a complaint with the BBB a while back. There is no mention of good or bad outcome of the complaint.
Needless to say this has completely made up my mind never to hire a contractor again because of this incident.
