My hunch is that Jesus was exposing all of the big-shots 1,978 years ago, and the big-shots (jewish authorities) decided to have him arrested and put on trial for starting a movement against all of the fraud, greed, and corruption, that was taking place in 33 AD.

The only reason...THE ONLY REASON you have NSF charges is because YOU continued to write checks or use an ATM card without having the slightest clue as to what your balance was when you used it!

What does your check register say?  You don't use one, do you.  Yes sir, its the same old cry and whine story from still another dummy who won't keep records and of course, its the fault of the bank, right?

You want to prevent this from happening?  Then its very, very simple, assuming of course, you actually do know how to add and subtract.  You keep a written record of every ATM card usage and check you wrote.  You subtract the amount from the balance right then and there and you keep a running total.  You add deposits ONLY when the bank's records say its been posted.  Following this practice will give you the MOST ACCURATE balance in the universe.  Before you use the card, you check your balance to see if you have enough money in the account.  That's how people used to do it before the days of so-called on line banking and telephone information.

So then...you now have the opportunity to say good bye to NSF fees by PROPERLY MANAGING you own checking account as described above, or you can write back and call me whatever name makes you feel good and continue to rack up NSF fees.  The choice is yours.

I believe there are laws that prohibit BofA from charging NSF fees on top of and as a result of their own NSF fees - in other words they can't create a new NSF fee that results from their own NSF fee.

Meanwhile I'll relate my story to you - and why I'll never do business with this company.  I had a loan with Countrywide that was assumed by BofA.  No problem.  I had my mortgage payment auto withdrawl set up so that my payment was split in 2 and paid on the 1st and 15th of each month automatically.  Great - never late no problems.

Middle of this year I think hey rates are really low I should refinance.   So I refinance with Quicken Loans - everything is going great but it goes down to the wire last minute.  I get a call the day before from Qucken that we can in fact close next day - which is also the 1st of the month and when half of my mortgage payment is due.   I call BofA to cancel the autodraft since Quiken will be assuming the loan and the paperwork will get to BofA before the 15th.   And, since the payment on the 1st will technically be an overpayment as the payoff amount from Quicken covers this payment.

BofA agent assures me my auto draft will be cancelled.   Fantastic so I make a big payment on my credit card to pay off my balance in full which I do every month.

2 days later I see that BofA went ahead and drafted my account for half my mortgage payment on the 1st.   So I call the bank and ask WTF I need you to return my money.  They say well you shouldn't have expected us not to draft it if you call the day before.  I said fine then why did your agent ASSURE me this would be taken care of - if she had said hey I'm not sure that will work I would have been OK with that and not paid off my credit card thereby depleting my bank account funds and putting me in a position of not having enough cash on hand to cover other bills due. They say I have to prove it cleared my account so I fax them a copy of my account off of the internet showing the transaction and my running balance.   No response for several days.  I call back again - this isn't sufficient evidence they say.  I ask why can't you check on your end - this was an autodraft so it's going ACH and you should see it on your end - well apparently they can't do that - can you BELIEVE THAT.  How stupid - they can't prove the payment cleared on their end - bullshit.  They can - just ask all those people who are late on payments  - BofA knows ALL about those payments.   Turns out BofA wants my month end bank statement - which is 45 days later.   What a crock.   So I have to get my bank on the phone on a conference call with the agent from BofA to ensure they can agree on what is needed from my bank to prove the payment has cleared.   Agreement is reached that my bank can fax a letter from them on their letterhead stating the amount cleared on their end.   This gets faxed.   Still no answer.   I call BofA - they can't find the fax - never mind that it was sent to the correct fax.   So, I ask my bank to send it to me so I can send it to them AGAIN.   By this time the Quicken refinance loan has cleared and the entire mortgage is paid off with BofA so they can't give me the amount back they have to now issue a credit for the excess balance on the account which is a credit due to my overpayment - this of course now requires additional weeks to process.   Bottom line 4 freakin weeks later I get my money back.  Meanwhile I had to take a cash advance out on my CC to make sure my car payment was covered and I came close to NSFs on other charges all because they pulled this BS on me.   I cannot imagine what would have happened to someone else who didn't have alternate financial resources that I did to cover their mistake.

They did this for one reason only - they wanted to hold on to MY money so they could accumulate interest on it.

I will NEVER do business with them again.
