Where to begin...I had a previous account with B of A, which I closed in around November of 2006. I opened a new account with B of A in June of 2008. When I opened the account (before I did it), I asked the customer service rep if I owed any money on the previous account (I didn't think I did, but was asking just to cover my butt, and have it on record). She told me I didn't owe any money on the previous account, and if I did, they wouldn't have let me open the new account until I took care of it. So I went ahead and opened the account online.

Everything seemed okay, until July 15, 2008, when I checked my online account, to see if my monthly debit from the ED Fund for my student loan payment came out. I was stunned to notice that B of A had taken $336.00 out of my account, and bounced 3 debit card transactions I had made that same day, putting my account in a negative state.

I called customer service number, and they said I owed money ($800 and some odd dollars) on a previous account that was forced to close. The customer service rep told me that they had charged me several fees (up until Jan of 07, when they closed my account) on a transaction that didn't go through, and that almost all the charges were for fees on this transaction.

I told her that the customer service rep I talked to when I opened the account said I owed NOTHING, or they would not have opened this account for me. She said she couldn't do anything about the $336.00 they already took out, but that she could just call it even, and wipe out the rest of the balance. I said okay, to do this, but that I didn't think I owed this money, and that I would fight it. I told her to send me all the paperwork showing these transactions.

I was then transferred to another customer service rep, to try to get the overdraft fees taken off (they hadn't yet shown up on my online account statement. This customer service rep told me that there were 2 NSF fees pending for $25.00 each, that would be posted the following day. She said if I made a deposit that day, I wouldn't be charged. I only had to pay $21.00 to cover the checks that were overdrawn. I made a deposit that day, and it showed my account to be at a positive balance.

The following day, the 2 overdraft fees for $25.00 were taken out anyways, and my account went in the negative balance again. I called customer service again, and told them what the previous rep had told me, that if I made a deposit that day, I wouldn't be charged for the overdraft fees. This rep reversed the fees, and credited my $50.00, which put my account in the positive balance again, when I checked online.

The following day, much to my surprise, there were 3 overdraft fees for $35.00 each, where they took out $105.00 total. The same day, I got a direct deposit from my employer for $921.00, and they subtracted the $105.00 from my account. I called the customer service rep again, and this time they told me that the previous customer service rep should have told me that these charges were on my account. WELL HE DID NOT TELL ME.

She said there is nothing she could do about these charges, because they are ligitimate, and tried to explain how it works. It was so confusing, and I couldn't understand how this could be legal. I then told her I wanted to speak to someone who could help me. She said, "I am it." I hung up on her. The following day, July 19, 2008, I looked on my account, and they have charged me yet another $35.oo overdraft fee.

I AM LIVID, AND SO ANGRY, I COULD JUST SCREAM!!!!! (I am being really nice here, I wont tell you how mad I really am). I feel as if I am being robbed by B of A, and that they can just take money out of my account for no reason, and charge me whatever they feel like charging me. There is no detailed information telling you what the charges are for, or when they occured, when you look online.

When you go online to chat with a live customer service rep, they say that "nobody is avialable to chat online," and direct you to call a customer service number. Each time I called the customer service number, I was on hold for excess of 30 minutes. I had to take off work 2 days, and could still get no good answers.

PLEASE PLEASE PLEASE A HUNDRED TIMES OVER, ANY LAWYER, TAKE THIS CASE!!!!!!! I AM NOT THE ONLY PERSON THIS HAS HAPPENED TO!!! WE NEED A CLASS ACTION AGAINST THIS HORRIBLE BANK!!!

Since the mortgage crisis BoA along with many other banks are using the NSF/overdraft fees to make up shortfalls. BoA used be a lot more lenient with there charges, and you could get them removed. But now they are actively enforcing these charges and using a little clause in your T&C with them. In short, do not go overdraw with BoA because they will charge and NSF fee, even if you were overdrawn for less than a day, and you will not get that fee back. Its no longer a community banking chaps.

and that's why you asked. No one would have any reason to remotely ask that question unless they knew without a doubt they owed money regardless of what bs excuse you want to throw out there. And seeing it was somewhere near $800, it's not too hard to forget especially since it was FORCED to be closed.
