dianna sullivan is not an honest employer. she tells her employees that they are considered indapendant contractors so she doesn't have to pay social security tax, state tax, and local taxes. she keeps credit card tips for herself that customers pay and doesn't redeem them to her employees. we work by the hour of a wage and i feel that this is fraud, tax evasion, and just all around not a good employer to work for.

Untrue accusations from someone who "needed a reason to quit"

This worker and a few others like her, are in part, one of the reasons I sold Bark Avenue. Vanessa was told upfront, before being hired, that she would be an independent contractor, and would be responsible for witholding her own taxes. In addition she was given an independent contractor agreement to sign which described what it meant to be an independent contractor, and what exactly she would be resposible to do for herself. She and I agreed on a wage that she would be paid by the hour, because she feared working on 100% commision. Later durring her employment, I found out I should not pay by the hour, That I could end up with problems as a result, and she was swithced over to commission. As a result, she quit, without notice or notification. After calling her for 3 days, and being hung up on without being spoken to, I replaced her. She then proceeded to file an application for Unemployment, for which she was denied, reason : Ineligable as a result of her quit without notice. In addition, before Vanessa was hired she was told that with her agreed wage, she would also recieve cash tips from customers. And that Bark Avenue accepted credit cards as a service to the customers, however, because of the cost to do so, ( credit card machine lease, monthly processing fees, and the percentage that was witheld for that processing) that workers would not recieve tips left on the credit cards, and to help compensate for that, - I, the owner, would take any cash tips left for myself - and dispurse them equally between workers. I guess that wasnt enough for Vanessa. Further more, in the state of Florida, if you recieve an hourly wage you are not entiteled to tips...only the wage you were promised. Vanessa was just greedy and wanted all the tips, regardless of reason. And on the subject of workers compensation, if you have 3 or fewer employees in the state of Florida, you are not required to carry workers compensation insurance. Which was the case for Bark Avenue. I never frauded anyone who worked for me, never cheated anyone, and infact went above and beyond for anyone who needed...I volunteered in my community, and supported any function that benefited children and animals. I am angry that I googled my business and found this report 2 years after the fact, I believe that if you are going to report a business publically, you should be required to notify them so that reports like this dont go unanswered for this long.
