Auto accessories store Big Boys Toys placed a order for me; a set of 4 Dub Esinem black chrome rims on 7/01/06. Order arrived 4 days later to find 2 of the four were defected.

Replacement order was placed for the 2. 2 weeks go by without a shipping of the rims. I decide to cancel that order and go with another company which the salesman was ok with and order a set of Brazen 530 rims.

Order was due to arrive within one and a half weeks. Rims show up and the salesman tell me that the boss has to talk to me regarding my order.

The owner Fadi tells me that he cant give me the Brazen rims til he get a credit back from original order. I asked him how long will that take?

He stated that he needed to ship to Dub rims back, Then wait for the credit then release the brazen rims. I think the Dub rims should have beeen shipped 2 weeks ago.

So i wait another week for the owner to tell me that MHT company will not give him a full credit for the Dub rims because all four rims were defected.

And that I needed to wait til this issue get resolved. Not only am i suppose to wait for a credit from MHT but also a claim from UPS?? I feel that Im entitled to a refund of my money back which was cash and i have an invoice of sale for $2300.00

Or the new order for the brazen rims for $1900.00 and a refund of $400.00, then the owner could deal with MHT and UPS for his credit or refund from that comapnys...

One month and a half later and nothing has been resolved...08/12/06

You paid in advance; now they are unable or unwilling to deliver the goods, so you are entitled to a full refund. And regardless of what the deal with the Dubs may be, the Brazens are 100% yours because you've already paid for them. They agreed to cancel the order for the Dubs, so you deserved your money back on them immediately. I assume you never even touched the Dubs so you are in no way responsible for them being damaged or defective. The store owner is totally full of BS saying that it is your problem he's having trouble with the manufacturer, shipper, or distributor. That is why it is often worth paying extra to buy thru a (honest) retailer instead of direct. The retailer takes all the risk of problems with suppliers. In the future use a credit card instead of cash whenever possible, especially on things that you can't be certain are good at the time you pay for them. If a merchant tries to jerk you around like this, you'd just call the bank and they'll take the money back from him.

so you should talk to the government people who license businesses, or consider small claims court if your $2300 is not excessive. The shop owner is taking you for a ride. Don't buy there again. I hope those $2300/set rims really make your day when you finally get them. I can think of much better places to spend $2300. There is no way I would ever spend money on car wheels beyond basic OEM replacement rims because I don't look at the wheels when I am driving, and I don't care what other people are looking at.
