Dearst Linda, Have a visit to my all time favorite consumer advocate, Budd Hibbs...google Bud and you will find his website. Bud has a recent article written about Boyajian, and the abusive collection practices that have been the continued norm with this slimeball pond scum.... Do NOT have any contact with this hairball! Keep a log of the calls,(the number of them, messages left for you, times you were called, etc.). Do not engage yourself with this lying cheat. He is the doo-doo on your shoes! Boyajian's time is borrowed, totally. File a complaint with the FTC, and Attorney General's Office in your state. Go have a read at Bud Hibb's website....you'll read what this abusive butt-head has been up to for way too long! Yes Boyajian DOES prey upon innocent folks, and seems to have a great time doing it....he's been scoffing at the laws as if they do not pertain to him. It will not belong before he will once and for all lose his ability to scam folks. He sends bogus debts to people who don't owe them, making it up as he goes. He duns the wrong people constantly, and does not give a whit that they are not the actual debtors. It makes no differrence to Boyajian if there is but a small matter of mistaken identity, when attacking unsuspecting people to pay a debt.....too many people have caved in a paid this loser after being harassed by him. Most probably didn't even owe the debt! Don't be intimidated by this piss-ant. Best wishes....

Stands for Federal Fair Debt Collection Practices Act' Google it, then read it. You will then completly understand what is legal for debt collectors do do and what is not. Also outlines all your rights as a consumer! The main ones are:- Calls allowed only between the hours of 8am-9pm (your time) Only 1 call per day No 3rd party disclosuer (they can't tell anyone but you that they are calling to collect a debt) Can not threaten to take any actions that they do not intend to take, ie they can't say they will sue you if they do not intend to actually do so! When they speak with you they must quote the mini maranda "This is an attempt to collect a debt, any information will be used for that purpose" Your have the right to DISPUTE the debt, and to request PROOF OF DEBT, no further action may be taken against you while the debt is in dispute! You can SIMPLY TELL THEN 'NOT TO CALL YOU ANYMORE' if you tell them that and they do call agin they are in violation of the law. The best way is to both dispute the debt and request they cease and disist in writting! Do this and most likly you will never hear from them again! BUT be carful, if the debt is legit and you do in fact owe it, do this can cause them to take further action, ie take you to court. All you have to do is let them know that you know your rights under the FDCPA and any violations will be reported the the FTC (FED TRADE COMMISION) they will treat you kindly afterwards!

....but that probably won't stop the letters or calls. I'd type and send a Cease Communications letter (but don't sign it). Whatever you do, don't call his office or take his calls, because once they start calling it won't let up. And NEVER give them your SS# when they ask for it. One of my co-workers has been receiving calls for months on a mistaken-identity debt claim, and even Cease Communication letters from her son (an attorney) doesn't get them to stop. A lawsuit is pending. Boyajian doesn't just target senior citizens, he's an equal opportunity shyster. You should also contact your state Attorney General and the FTC if the harrassment continues.
