Attorney Brett Elam was referred to us by a friend. We were having some issues with the homeowners association which was trying to foreclose on the house. The mortgage and other bills were up to date. Everything was being paid on time but the association was really trying to sell our house. After we meet with the so called attorney, he adviced us to file chapter 13 to avoid the sale of the property. The association didn't want to negotiate with us and were truly making things difficult for us. We took the chance. This was the biggest mistake of our lives!!! This individual took our money (which could have been paid to the association and save ourselves all these nightmare) and left us in the dark.
He advised us not to pay any of the bills, that he would take care of everything through the bankrupcy...His negligence costs us the house and a huge mess. In the end, the association sold the property. I cannot describe to you how frustrating this has been. We called him so many times. He never answered any of our calls. He went on vacation, fired his paralegals, hired new staff, you name it!!! There were more and more excuses but nothing to do with the job we hired him to do. Papers were never filled in court, his emails were contradictory. The bottom line we went to see him in regards to the association, not even the mortgage or anything else and he couldn't take care of it.
I called the florida bar association and they already have some complains against the guy for similar issues. I wish he could tell my kid that his parents hired a very incompetent attorney therefore he doesn't have a place to sleep. It's unfortunate but it happened. Please don't hire this moron to be your lawyer!!!He will take your case, your money and run like a coward. One last thing, he gave us his cell phone number the only day we saw him saying he likes to stay in touch with his clients...He never, EVER answered or returned any of our calls. We found out about the house through other sources. Thanks us later...This guys is an embarrassment to the legal profession. He should not be allowed to practice law.
