I have been trying to negotiate a settlement with McPartlon Roofing for nearly three years.  I had three new roofs put on different buildings in 2006 and they all  leaked in January, 2007. The interiors were damaged and mold grew. McPartlon tried to patch a few places, but it soon became obvious that the roofs were faulty and would need to be replaced.  



Brian McPartlon informed me that I would need to contact his insurance company and deal with them exclusively.  He also told me that if I did anything to repair or replace the existing roofs on my own he would not honor the warranty.  After months of having plastic tarps on the roofs and finally blowing away, my attorney advised me to replace the roofs at my own expense since McPartlon was not showing any intent to fix or repair them.    



I replaced all the roofs in June, 2007 only to discover that on one roof McPartlon had not torn off the old roof and installed a slope system per our contract.  He merely put a membrane over the existing roof and billed me for a whole new roof.  During the remainder of 2007 and the first half of 2008 restoration continued on the inside and outside of the buildings, all at my expense. 



Inspections and mediation sessions were set up through my attorneys and McPartlon's attorneys in conjunction with his insurance company, USF Insurance. The night before or the day of the meetings USF agents would call and cancel the meetings throughout 2008.  This ran up my attorney's fees to the point that I could no longer afford an attorney, especially after two sets of new roofs in a one year period plus restoration and mold remediation. 



I have tried everything from the Attorney General's office to the Better Business Bureau without success.  All McPartlon does is state that on the advice of his attorney he has no comment so any attempt to make a settlement goes nowhere.  I have also appealed to McPartlon directly, offering to settle for $50,000 instead of the $108,000 this disaster cost me but to no avail.  He simply does not respond.



The consumer needs to know that McPartlon is not reputable and that if there is a significant claim McPartlon and his insurance company will do everything they can to avoid payment.  The statue of limitations will run out on my case in December, 2009 and unless I want to file an expensive lawsuit and go up against a huge insurance company there appears to be nothing I can do.  USF Insurance has made it clear that it plans to run up my bills until I give up.

I am pleased to hear that Brian McPartlon Roofing fixes small leaks and stood by his warranty in your case.  My point is that McPartlon and his insurance carrier, USF Insurance, did not honor the warranty in my case or attempt to make any kind of settlement with me even though my roofs were only a few months old.  


McPartlon knows every trick to avoid tarnishing his reputation.  Try filing a report with the Better Business Bureau and you will find that all he has to do is say that on the advice of his attorneys he has no comment.  The BBB can do nothing after that as they are a dispute resolution agency.  Try filing a complaint with Construction Industries and you will find that they only take complaints dealing with code violations.  Try suing a huge insurance company and you will discover that each party pays their own legal fees so there is no way most people can financially afford a lawsuit. especially after putting on multiple roofs in one year.  

The internet is the only way I have found to warn the public that if you have a huge claim against McPartlon Roofing, Brian and his insurance carrier will not honor the warranty or reimburse your out of pocket expenses.  My homeowners policy covered only a fraction of the costs because mold grew while Brian McPartlon was on vacation and he had instructed me not to touch anything until he returned.  Mold remediations is not covered by insurance so buyer beware!

I have been a customer of McPartlon Roofing for over 14 years now.  I can honestly say that their customer service and loyalty in honoring their warranty has been exceptional.  I have referred many friends and family members to this company.  As far as my warranty is concerned, every time that I have had a leak, which has happened twice in ten years, they have come out to fix the leak within 24 hours.  Also, it was the same person who came out to fix the leak each time.  Doesn't that count for something?  The same person has worked for the same company for that many years.  My opinion on your report is that every situation is specific.  There may have been more factors that contributed to this situation than you have listed.  There are always two sides to every story.  I find it very sad that you have to post your personal experience on the internet for everyone to see.  I am very surprised that McPartlon Roofing has not responded to this. I have had many friends in Santa Fe that have used McPartlon Roofing and they have all been extremely happy with the service.  Ultimately, to all of the consumers who are reading this, please take my advice and do not "listen" to this person.  If you experience McPartlon Roofing on your own, you will see that they are a wonderful and honest company who have been around for many years.  I also read that they won "Best of Santa Fe 2009".  Now, they wouldn't give that award to just any company, would they??
