CACH LLC G. Reynolds Sims purchased my $5,000 debt from Providian and now is suing me for a different amount. The first court papers said $9,632.47. They have since taken $828.38 out of checking account with no notice, garnished my wages, and put a lien on my house. Now the total on the house lien says I owe them $9,811.96 and the lien is good until 2016. They have contacted my employer, my mortage company, and just won't stop.

I have been working with a debt company and CACH refused to work with them. Absolutley refused to make any payment terms or considerations. They are slime!

Sims has a reputation for suing on behalf of CACV and CACH, both of Colorado. He does not follow fair practices expected in court procedures, and this is the best way to trip him up. You MUST point these out to the Judge for action. Always be aware of the time limits the court allows in response, the statute of limitations for suing (Michigan is 6 years). Make him produce ALL original documents that validate the debt and EVERY charge added to arrive at the balance he is currently seeking to collect. He will not settle, so don't waste your time trying. You must beat him in court at his own game, which requires attention to detail on your part or he will trip you up. Sims likes to put up a big smoke screen knowing he lacks most of the necessary documentation if you press him in court. When you say the first court papers?, have you already been sued and a judgement have been placed against you? Without a judgement none of this can happen. this sounds like a very old account, to jump from 5000.00 to almost 10,000.00. SOL are 6 years in Michigan. Close your bank account, cause everytime, you make a deposit, it will be taken. If a default judgement was placed against you, check with legal aid or an attorney to see if you can get it vacated, also see if you can get back into court, on the wage garnish and see if a more reasonable plan can be made. there are some statutory ways for hardship and their only allowed to take so much. With a judgement against you, you can really only do so much. If there is no judgement against you, and these things are happening, you got a real nice payday coming.
