Don't just say it-do it! Follow thru with a good consumer credit attorney. It appears that they willfully violated the Fair Credit Reporting Act. They KNOW d**n well that they CANNOT reset the age of the debt to the time that they purchased the debt/accepted assignment of the debt. The age of the debt is the date of the CHARGE OFF from BP Oil and if it is over 7 years old it CANNOT BE REPORTED on your credit reports. This is a violation of the FCRA! You could sue them, but you might get quicker results if you send them a certified return receipt requested letter that clearly indicates that the age of the debt WOULD be the date of the charge off by BP Oil (OR the date that you paid the debt in full) and is not the date that they "took it over." Also demand that they IMMEDIATELY NOTIFY THE CRAs to DELETE this entry on all credit reports about you. You could also go through the motions of demanding validation, but you claim the debt was PAID so you should DISPUTE the debt in it's entirety for that reason. Lastly, you should instruct them that communication must be in writing only and that any further telephone calls from them attempting to collect this debt will be considered deliberate violations of the Fair Debt Collections Practices Act and as such are actionable in District Court. That should do it. I would give them about 45 days and then I'd check your credit report to see if it's removed. If it isn't-LAWYER TIME! Good luck.
