It seems that Capital Management L.P. / Capital Managment Services has purchased an old debt of mine from US Bank that had been written off by them as bad debt against my credit. Capital Management has gone WELL beyond the limitations of the "Fair Debt Collection Practices Act" by contacting my parents, my brother/sister-in-laws, and my and telling them that we are going to lose our home because of this debt and that they need to make us pay. They have been repeatedly calling my relatives and are trying to create fear and intimidate me into paying off this debt.

I had contacted them to try and discuss the issue and after our conversation became heated they stated that they are going to continue to pursue it through my wife and relatives and will not talk to me any longer because of my refusal to pay them immediately. I unfortunately had several of my family members call me today out of fear because of the harassing calls they were receiving from Eddie Watson at Capital Management Services. They were very upset and concerned that our home and lives were in danger because of the calls they were receiving.

I can honestly say that I will not pay these people one single penny. I would much rather pay an attorney more than what I owe for the debt as a matter of principal. I would even consider negotiating with the initial creditor if I had assurance Capital Management Services would never see a cent. I personally recommend anyone who has been contacted by them to NEVER pay these people ANYTHING and would also recommend a class action lawsuit against Capital Management L.P. as well as the companies selling them the debt. This is because of Capital Management Services / Capital Management L.P. making it a regular practice of breaking the laws set forth by the "Fair Debt Collection Practices Act".

I have given them a means of direct contact through my cell phone - they are not allowed to then contact relatives in a manner to intimidate or scare them so they talk me to paying for the debt. I feel like a guy named "Rocco" is going to show up at one of my relatives homes telling them they need to make sure I pay the money.

Sounds good but what about wiretap laws

You need to be sure you notify them you are recording the conversation. Check on the laws of your state. Some states will allow a personal wire tap without the others party consent and some don't. If you state does not allow wiretaps without the other parties consent the tape is not admissable in a court of law and you can find yourself back in court as a defendant as well.

I am not an attorney. However, What they are doing I believe is illegal. Its time to play hardball with them. You need to research and purchase equipment to tape the what these dirtbag mobsters are saying to your relatives. Now, I would purchase a tape recorder that allows you to patch into a phone line. Work with your relatives and have these dirtbags taped. Once you get the incriminating conversation then contact an Naca attorney. They love cases like that. They are slam dunk and money at the end of the rainbow. You need to prove the calls by recording several conversations. I truly suggest this. Its cheaper to get the evidence yourself then hiring an attorney. Get the evidence. I copied one such item at Radioshack. I am not a radio shack fan. But the are the quickest and most knowledgable source.
