Capital One Bank, N.A. are a bunch of scam artists and ripoff agents!

Allow me to explain.

The NYS Department of Taxation and Finance put a levy on my joint checking account on June 8. It seems that the IRS was a bit slow in giving them the part of my federal refund that they were entitled to. When the NYS Department of Taxation and Finance received the money on June 10, they released the levy on the joint account.

This is where it starts to get ugly with Capital One. They place the levy on the account on June 18, OVER A WEEK AFTER THE LEVY WAS RELEASED! They do not send me any notification of said levy. I find out by accident on June 19 when I use the automated system to check my balance because my husband asked me to get a couple of things on the way home. When I see that the account is overdrawn by nearly $2,000, I start to ask questions and find out about the levy, which I thought was done after my conversation with the NYS Department of Taxation and Finance last week.

NO NOTIFICATION of the levy had ever been made from the legal (A/K/A illegal) department, as is proper procedure. I only found out by accident.

After speaking to two very helpful individuals in the NYS Department of Taxation and Finance, they faxed over a letter to Capital One's legal department TWICE that the levy had been released on June 10. Their legal department was so lazy that John from the NYS Department of Taxation and Finance had to scream at them to look in their fax machine. The letter had been faxed twice- once at 12:15 p.m. and again at 12:45 p.m. The legal department of Capital One was just too lazy to look in their fax machine.

Anyway, the levy was released at the end of business yesterday and I tryto use my ATM card to withdraw money. Guess what? It was no good! My card and my hisband's card were cancelled because of the levy, but someone forgot to tell us! We both had to get new ATM cards.

Fast forward to this morning and the checking account is now overdrawn! They hit me with three overdraft fees at $35 a pop and a $100 "processing" fee. That is over $200 of our money and their customer service refused to return it- in fact, their manager in the bayou crank called my house number twice. Duringt he second call, I could clearly hear his conversation with a colleague even though I was saying "Hello, hello!"

Fortunately, my branch at Avenue U in Brooklyn, namely an associate named Kira, was very helpful and said she would bring this to her manager's attention on Monday so these fees could be reversed. However, it does not make up for the aggravation and time I wasted on a alleged levy that ended over a week before the bank put it on my account.

Last week, I received a statement from Capital One Bank showing that my old checking account had a zero balance and was closed like it was supposed to be on July 17.

It's about damned time!

They finally realized I wasn't going to pay for someone else's screw up that re-opened an account that was supposed to be closed.  I hope the bank employee or whomever did this gets arrested!

This drama will never end!

The accounts which I went to the branch to close after the NYS tax debacle on July 17 of this year were re-opened on September 3, but not by us.  We did not make that deposit!  What makes it worse is that someone overdrew the account and now Capital One is coming after us for the money.

I am on my way to the police tofile a report against Capital One Bank for identity theft.  Too bad lying and abusive customer service isn't against the law- it should be!  Since North Fork has become Capital One, I am deeply ashamed of what their customer service has become.  They need to be arrested for misusing our personal information!

Robert dear, it is not necessary to make me out to be an idiot. I know what a court order is. I received a letter from the NYS Department of Taxation Office of Civil Enforcement and the papers were SERVED on the 8th of June, not mailed as you suggested. It simply makes no sense to put a levy on an account AFTER IT WAS RELEASED! Included with the letter was a copy of the fax machine transmission log, Therefore the NYS Department of Taxation was able to prove when the letter was faxed. They also provided me with a copy of the letter faxed and the levy was indeed released on June 10. Therefore, placing it on the account on June 18 was indeed a bank error! Also, the legal processing fee was NOT in their disclosures when I opened the account. In my new account at my new bank, I did find it, so if God forbid it happens again, it will be no surprise. Stop pontificating on these boards like you know what you are talking about because you defintely don't!!!!!

A levy is a COURT ORDER. A bank can not decide when and how to obey the order. Once they process the order they must comply, there is not time for them to notify anyone in advance. They also can not release the levy until they get another court order stating to release it. You are also taking the word of state government officials that they actually did fax a document at 12:15 and 12:45pm. But if they did look at the times...in most businesses that is lunch time and they may not have even been there. As to what probably happened. Most likely NY placed the levy and MAILED out the notice on the 8th. It could easily take 10 days for it to get delivered and processed by Capital One(or any major bank). Most likey the release was MAILED out on the 10th(or 11th if it was later in the day) and since you said it was released on the 21st, that is again just about 10 days later. NO bank will notify you in advance. If they did people would just remove the money before the levy takes effect. You also probably caught it soon enough to where a notice from them was not sent out after the fact. I am not saying this is right, just that this is a possibility of the events. Also, that just that you probably would have had the same experience at any other bank including the "processing fee".

I called my branch at East 22 and Avenue U this morning and while they are returning the three bogus "held funds" fees at $35 a pop, they will not return the $100 "special processing fee", WHICH WAS NEVER MENTIONED IN THE DOCUMENTS I RECEIVED WHEN OPENING THE DAMNED ACOUNT! Consequently, I will be closing ALL of our Capital One accounts, including our safe deposit box, and moving it to Bank of America since through my employer, I receive a free checking and savings account, just like I had at Capital One. I will NOT DO ANY BUSINESS with a company that feels free to help itself to my account for bogus reasons.
