CapitalFirst sends you a packet of information that you have 7 days to examine, and cancel if you don't want it If you don't respond with 7 days, your checking account is billed $99.95 and $59.95 for membership fees and processing fees.

SmartMail Services handles their mailing. It was postdated July 19, and I received it on July 23. I called July 25th to cancel, but my checking account was already debited for the above amounts on July 22.

I talked to "Nicki" on July 25 (customer service rep for CapitalFirst). She stated that the packet was sent on July 3. I told her it wasn't sent until July 19, and that I was within the 7 days cancelling, and I wanted my money back. She asked me "how do you know it wasn't mailed until July 19." I told her it was on the packet - the mailing date. She answered "we don't have any control over the mail". I told her I agreed with that, but they did have control over their mailing service. She said, "send back the packet and ask for a $99.95 refund, and they will decide if I get it, and maybe refund me in 14 days." I told her that I would be sending back my "proof of mailing date if I did that". Nikki stated "that's the way it works."

I contacted the mailing service, "Smartmail", and they informed me that all mail is sent the day following it is received, and they have a guarantee of 1-4 day delivery. I told them the problem, and that CapitalFirst is putting the blame on them. Smartmail was supposed to report this to their supervisor. The Smartmail rep stated they had had several calls regarding this same issue. She also stated she thought there was something on the internet about this ripoff. That is how I found this posting.

CapitalFirst is ripping of a lot of people for almost $200. Surely there can be a class action suit of some type to stop this fradulent company.

I am sure there are a lot of people who could be hurt financially to have $160 taken out of their checking account when they weren't expecting it.

I am happy to report that Capital First did not get the best of me. After filing this report,I contacted my credit union, told them of my stupidity, and the end results - ripped off. They told me that they would see what they could do, and would get back to me. To my amazement, the money was credited back to my account within 3 days!!!! I don't know if this being a credit union instead of a bank had anything to do with it or not, but I sure am happy. This is now January, and no further debits of this type have been taken from my account. Try doing this yourself - GOOD LUCK.
