I have been getting phone calls from American named men who have very strong accents. They called and leave messages saying that its urgent collection matter.
I do have some unsettled debts so I will call numbers that leave messages like this back but asked the man to send me paperwork to prove to court order or action placed against and/or the settlement agreement I can take.
He then tells me that I have 2 options to pay him four hundred something dollars to him to settle it or that I will have a court order placed against me for fraud and theft and will be arrested and that once I lose that I will have to pay anywhere over 2,000 dollars in court costs. 

 I have to say that at first because I am in a good bit of debt that I was worried but when I would try and ask for paperwork or any proof he wouldn't give me any or ask for an address to send me papework. Also, as soon as I brought up talking to my attorney about needing paperwork and or him talking to them he immediately told me to tell my attorney to call the sheriff and hung up.

 How do I get this place to stop calling me? I also read a similar complaint where they were calling my work and I'm scared I will lose my job because I work in retail and they will not take to kindly to me getting phone calls there. Please help.

What you are experiencing does not sound like it is coming from the CashNetUSA team, but rather a scam ring that has been using our name to sound legitimate.  Please follow the advice below on how to recognize a fake collection call, and also how to report these people.

- Recognizing Fake Collectors
Our in-house collectors follow strict policies and procedures, industry best practices, and comply with the law. These fraudulent collectors do not.

You should be suspicious that a collection caller is fraudulent if: 
You have never received a cash advance from/through CashNetUSA, Payday Advance, Cashland, Cash America or SuperPawn.
You received a loan with one of our businesses, but paid it back in full.
The caller threatens violence, intimidation or uses foul language.
The caller threatens arrest or other criminal action, or references your drivers license or check fraud. he caller threatens to garnish your wages.
The caller is unable or unwilling to provide loan agreement information or payment history when you ask for it. 

According to some of the people who have received fraudulent collection calls: The callers have a strong Indian (Asian), Middle Eastern, or other foreign accent.The caller reads out your bank account, Social Security Number or date of birth (this is done by the fake collector to show legitimacy). The caller has very poor English speaking skills. 

- Reporting A Fraudulent Collector 

If you have never received a loan from/through CashNetUSA, please call 888.801.9075 to provide us with the details of the incident that we can share with authorities.
If you have never received a loan from/through Cash America, Payday Advance, Cashland or Super Pawn, please call 800.773.3147 Ext 3822 to provide us the details of the incident that we can share with authorities.
Contact your State Attorney Generals office and the Federal Trade Commission and file a complaint. Use the FTC link https://www.ftccomplaintassistant.gov/ and reference fake payday collection fraud.
Do not give out any personal information out. If you are a current CashNetUSA customer, log in to your online personal account to confirm the status of previous loans. If you are a current Cash America, Payday Advance, Cashland or SuperPawn customer, please contact the customer service number located on your loan documentation.

Likely these guys are a scam.  If they are legitimate they will know they must provide you proof of the debt.   They should be willing to provide you with a phone #, address, and internet website for their company.    If they don't want to provide their info I would act like you are wanting to work with them and say hey where do I mail the check, look and see if their # shows up on caller ID and try calling it back, ask for their # so you can make sure to stay in touch on getting things paid.  Once you have all of that look them up on the internet.   Send them a certified letter asking that they not contact you at work - by law they are required to comply with this request.  

If they refuse to provide any of the above they are a scam so tell them to go jump off the nearest cliff.   Laugh at them and make sure your employer knows there is a scammer out there going after employees of his company.   Your company should not hold you responsible for that.

To Whom It May Concern:

This letter is being sent to you in response to a phone call (date and time) regarding a debt on _________

Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

Please provide me with the following:

What the money you say I owe is for;

Explain and show me how you calculated what you say I owe;

Provide me with copies of any papers that show I agreed to pay either you or the original creditor what you say I owe;

Provide a verification or copy of any judgment if applicable and identify the original creditor;

Prove the statute of limitations has not expired on this account

Show me that you are licensed to collect in my state and;

Provide me with your license numbers and registered agents;

At this time, I will also inform you that if your offices have reported erroneous information to any of the major credit bureaus, this action might constitute fraud under both federal and state laws.

Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:

Violation of the Fair Credit Reporting Act

Violation of the Fair Debt Collection Practices Act

Defamation of character for contacting any other person than myself regarding this alleged debt.

If your offices are able to provide the proper documentation as requested in the preceding, I will require at least 30 days to investigate this information and during such time, all collection activity and calls to me must cease.  

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

If your offices fail to respond to this validation request within 30 days from the date of this certified mail letter, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.

I would also request that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.

It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records, any information obtained shall be used for that purpose.

(WHY: because these bottom feeders will scan your signature and fraudulently attach it to documents as an attempt to validate a debt or an agreement with them.)

Be SURE to send it certified or registered...above all, keep the receipt, attach it to a copy of the letter you sent and all their correspondence.

If they call, write down the time, date and whom you spoke with. This is invaluable if they do this after receipt of certified letter.
