Hi Sandra noticed your post about Centex and your story is so similiar to another post here at RipOff's, Priscilla White, Peabody, MA., and you are not alone in this fight. Centex is not the only one but they do hold a license in NY and you have rights and recourse. Contact the FTC, HUD, IRS, NY Banking Commission, NY Licensing Unit, etc. You need to write a RESPA letter to Centex, just go to the HUD web site they have sample letters. Send copies of the letter to our Attorney General Eliot Spitzer, he has listened to other consumers in the past about predatory lenders and servicers, like Household Finance and Fairbanks. Know your enemy. Also suggest you post your comment at his message board, Spitzer 2006, and file a complaint with his department. Mr. Spitzer is well known for his defense of the consumer and with his attention being toward fiduciary duties and ethics in the insurance industry, the mortgage lending industry is wearing the same shoes and hopefully will be next. Also there is a lot of support out there, do a search on mortgage fraud or predatory lending and join in the fight. Many of these groups not only offer support, but have so much information about the laws and prior situations it will help you to fight back. There are organizations that can help, in Priscilla's situation she was able to obtain assistance from the NCRC, who has offices in NY. They provided her the means of refinance with a regulated lender. Sandra your comment on Centex's comment that they would allow you to refinance within 6 months, then deined you, double check your contract. Next compile a diary of all conversations, emails, letters, and most importantly copy those cancelled checks. I hope this gives you some direction. Fight back and document everything.
