On July 12th, 2013, I paid Mr. Perkins $1,300 to build me a finished 59 Les Paul Replica Husk.  November 13, 2013, Mr. Perkins sold me hardware for the build $465.  On June 2, 2014, I sent Mr. Perkins a beautiful $280.54 piece of quilted maple from CurlyMaple.com. This brought my total investment with Mr. Perkins up to $2,070.54.

After waiting 2 years for Mr. Perkins to finish my husk and growing sick of his delays/excuses, I was told my options were to take what Mr. Perkins had compiled, or to give him even more time to try to assemble a husk which was not exact to my order. On August 2015, Mr. Perkins sent me an unassembled and unfinished guitar kit, which did not contain my maple top and was full of blemishes.

Upon asking about my maple top, Mr. Perkins said the wood wasn't quality enough and was damaged during the building process.  Here is a link to a thread on TheGearPage where I posted pictures of said blemishes the day of receiving the kit from Mr. Perkins.  

After I received the kit, I immediately contacted Mr. Perkins to inform him of how unhappy I was and asked for a complete refund. On September 24, 2015, Mr. Perkins emailed me to confirm he would be providing me a full refund of my investment, since it was not to my liking.  Here is a copy of where he states that in his email to me below.

I had offered to build the guitar out for you with no additional costs, basically to whipe out the balance and complete the work but I will be just as happy to offer you a complete refund and maybe a little something extra to get your next burst build going, a neck or maybe a flametop with old wood.  Name it and i'll hook it up.

As of June 6th 2016, Mr. Perkins stopped making payments towards the complete refund of my purchase, leaving me with a $1,020.54 balance, which he is refusing to now pay back. He is claiming that I had modified the kit before sending it back and that he had a shop policy of only refunding on his labor, not materials.  

This is completely false as Mr. Perkins never brandished any said policies upon our agreement and had said in writing that I'd be entitled to a full refund on September 24, 2015. It is also a false accusation that I modified his guitar kit.

The kit was inspected by 2 local luthiers in the Bay Area who said the kit would need a lot of work to assemble, including shimming the neck.  If Mr. Perkins felt that I modified his kit, then why did he not notify me of this back in September of 2015?  Why did he start making payments towards my complete refund after I'd sent him the kit back?  Why is it that he is just now mentioning this excuse as his reason for not providing the refund?
