I placed an order for a cell phone. Right after I did, a friend showed me how Cingular supports animal abuse by giving money to rodeos. I canceled the order RIGHT AWAY. I also told my credit card company to stop payment on the order. I e-mailed Cingular to stop the order. But, I just received an order update from them, and it looks like they are still processing it.

My money should not have to go to torturing animals. In rodeos, gentle calves are violently roped to the ground...jerked to the grounds by their necks as they run up to 27 miles per hour. It's just sick.

No more Cingular or AT&T for me.

William, unfortunately the law is probably against you. You likely entered into a contract with Cingular and, by attempting to repudiate the agreement and stopping payments on it, you are in breach of it. The contracts employed by cell phone companies are heavily weighted against the consumer. They are also, for the most part, quite enforceable. And just because you feel that you canceled in a timely fashion, and even as no services have been extended, you likely still have some legally enforceable liabilities. In the end, it is likely that you will at least owe a steep early cancellation penalty. You made a principled choice, and I don't think anyone can fault you for that. Unfortunately, principled choices often involve harsh consequences. But when they do try to shove the early cancellation fee, or any other fees down your throat, you do have a couple of legal weapons that may be of some assistance. First, see what you can do to get out of paying the fees altogether by informal means. If they still assert that you owe them something, file an update with such information and I'll see if I can't give you a little practical advice. Best of luck!

You mention you cancelled your order "right away" yet Cingular "never responded." Well, just HOW did you cancel? Did you send them a random email thinking that was enough to cancel, and then were upset when you did not get an instant response? Perhaps you should PICK UP THE PHONE and talk to a live human being, telling him/her that you would like to cancel and allowing him/her to give you a cancellation number. As for your allegations that Cingular promotes animal abuse, just where are you getting your information from? I'd like to see the documented source of these allegations if you'll kindly provide it.

It's easy to cancel your order. Once you receive your phone there should be paperwork included that gives you instructions on how to return it. Usually it's just a phone call and they will ask you to ship the item back. They will then credit whatever you paid. Easy. I think you have 30 days to return the phone and cancel service. This is how most online companies process returns. Heck- you may even be able to bring it to a local store and return it there. Some companies do this- I don't know if Cingular does. You'll have to check. Many companies cannot cancel orders placed online. The item is returnable for refund though. Hope this helps.

I have a cingular go phone so it was quite easy for me to stop using their services. I simply bought another pay per minute phone and the cingular one lies dormant until this company decides to cancel their partnership with animal abusers. As for your problem at hand. Keep calling. Do you have records of when you contacted them? Because there should be contract laws in your state. If you can prove you contacted them within the state limited contract dispersal time period, they can't hold you liable for that new phone order. Keep calling is my best advice. Write down the name of every agent and manager you speak to. Visit a cingular store, and demand your money back. Being in their face is the only way to get this reversed. Trust me. Being a bother causes them more grief than they let on. My commendation for you for stepping up to the plate, William.

It is a Rip-Off

This incident was a rip-off. I placed an order, canceled it, and was ignored by Cingular. They didn't cancel the order. They didn't even respond. Can't get anymore of a blatant rip-off than that. I did file a complaint with my Attorney General's office. I am a consumer protection expert, so I will get the charge removed. That won't be a big problem. Cingular could have done it the easy way, but instead we'll do it the hard way. Your friend showed you something that states Cingular supports rodeo's? Weel that's fine. I am sure I can show you documents that show Cingular gives money to animal shelters. What you have is not a rip-off. What you have is a decision based on principle. your beliefs for the safety and welfare of anmials is what made you change your mind. For that I applaud you. However, you have a signed contract and you're stuck with it unless you want to pay through the nose to get out of it. There is no rip-off here. On a personal note, rodeo's are boring. Who wants to watch some s**t-kicker wanna be chase his or her relatives around a ring and try to rope them? Not me. I prefer beef tame; as in on my dinner plate. Cheers!
