It is HIPAA - I work for a Corporation that owns hospitals nationwide I have had to training in HIPAA as do all of the employees have had to do be it Doctors, Nurses, etc Stacey

I am a former employee and Partner of the late attorney Irving Dross. I recently came across this report and found it rather disturbing in that it tends to shed a negative light on a truly great attorney who helped so many people in our community. The report itself also contains a few inaccuracies, and portrays certain events out of context. First, let me say that Irving Dross was a well known and well respected personal injury attorney who represented and helped thousands of clients in Washington D.C. and Maryland over his nearly 40 year career. He passed away in April of 2005. Just a few of his accomplishments are as follows: He was memorialized in the permanent records of the Charles County Bar Association and the Prince Goerge's County Bar Association. He was successful in numerous large cases that made new laws and provided life changing recoveries for numerous victims and their families. He was a Court-appointed mediator in Charles County, he was the Chairman of the Charles County Ethics Commission, and he volunteered his time with numerous public service efforts, including the Charles County Teen Court Program, designed to help rehabiltate actual juvenile offenders. It would truly be a shame if anyone were alow this report to tarnish his distingushed career and his reputation as a great lawyer. Now, as for the report, I am familiar with this case and the report is not completely accurate. Mr. Dross did take this woman's case, and he did feel there was a potential medical malpractice involved. However, after having the case reviewd by a Medical expert, he was given the opinion that it would be a difficult case to pursue, and he decided that he did not wish to go forward on her behalf. (the proper proceedure would have been to send the client a letter, which was apparently not done By Mr. Dross or the staff in this particular case - an extremely rare occurance - and admittedly a very serious oversight) When the client and her husband contacted him several years later, he was surprised to learn that they were unaware that he had decided not to go forward with the case. When they came to meet with him, he told them that although he recalled telling them that he wasn't going to go forward, he had pulled the file and he had no evidence that they were ever sent a letter telling them in writing. He apolgized profusely and accepted full responsibilty. He did not say in any boastful way whatsoever "go ahead and sue me, I have plenty of insurance." He explained how the process would work, and explained that since the client's case against the doctors was now dismissed, she had the right to consult with another attorney and make a claim against him and his malpractice insurance. Unfortunately, when an attorney represents thousands of clients over many years, there is always the danger of a clerical error occurring. We strive to avoid them, and they are very rare, but they do sometimes occur. Mr. Dross took full responsibilty , and made sure the client still had recourse to protect her rights if she desired.

Unfortunately, HIPPA privacy rules make it illegal for physicians to reveal any information on a patients chart, so "rebuttal" in a public forum like this one is impossible. I got a little bit of information that may help you at this point. First, Call Charles Countys Legal Aide to find out the exact statue on your original case. Then ask them what to do about Mr. Dross. As for the law firm of Dross, Levenstein, Perilman and Kopstein; they are located in Waldorf Maryland and Lanham Maryland. As for the parties in this firm, The only Levenstein listed with the Maryland Bar Association works with the firm of Houlon and Berman. I cant find the partner of Perilman. And Mr. Drosss son Justin Dross also works with the firm in PG County. Now where to go from here. In case you wanted to email Mr. Dross, his email is [email protected]. But as these doctors go, I know someone that had their varicose veins removed. The removal surgery was so botched that they developed a Stacie Ulcer (spelling ?). I know another person that had the same surgery and again had complications as a result. He ended up with numerous blood clots. One that went to his heart and cause an heart attack. Hopefully you see this rebuttal. I wrote the first report on Civista. When I read you report, I noticed the name Dr. Espinoza, if I'm not mistaken, you're not the first with this or simular problems. I will se what I can find as to what can be done at this point. By the way, the attorney you saw, well, I do know he has been reported to the bar association for other dealings. You may want to go ahead and send a copy of your report to them. Look, I will file a rebuttal when I get some more information, so please check back and give me about two days. Thanks and good luck!
