Threats, Trespassing, Parking Misconduct, and Noise Pollution Caused by Clover’s Lawn and Landscaping of Billings, Missouri

I was awakened this afternoon (I am on a nocturnal schedule) by work being performed by Clover’s Lawn and Landscaping of Billings, Missouri - a company that is listed as being owned by one Johnny D. Clover.  The work created noise pollution that defies the local Springfield, Missouri noise ordinance, especially as Clover’s loud industrial noises lasted for many hours.

When I got out of the shower, I looked out my front window to discover that a Clover’s representative had decided to park so that his vehicle was completely and entirely blocking our driveway.  It prevented ingress or egress to a property where a resident (myself) is disabled.  If I had experienced a medical emergency, I might have died or incurred serious injury during the time I would have had to spent waiting for the proper removal of this truck.  I also noticed that Clover’s vehicles were blocking the street for long periods of time during the afternoon and evening hours so that, even if the truck had been moved, passage to a hospital or other public facility would have been, in essence, impossible.

When I called the number listed on the side of the Clover’s truck, I spoke with a woman who refused to offer her name and explained that this wasn’t her problem because her husband wasn’t the party who had illegally parked the vehicle.  When I told her, curtly but without malice, that it didn’t matter who had mis-parked the vehicle, she flew into a rage and began yelling.  Unable to pierce her loud and malicious tirade, I turned off the phone.  I have, however, retained an audio copy of this conversation.

A couple of minutes after the termination of the initial phone conversation, a Clover’s employee trespassed on our property in order to move the truck.  Although we wanted the truck moved, the Clover’s employee should never have parked it thus in the first place and should not have had to trespass on our property in order to move it.  He trespassed again only a handful of minutes later, however, in order to re-park his truck in the same illegal and potentially life-threatening position.  After this, the truck was left blocking our driveway for several hours (we have gathered photographic evidence at various times of the afternoon and evening to show the pervasive misconduct of Clover’s Lawn and Landscaping in this matter).

I did attempt to have the truck moved a second time by again contacting Clover’s to tell them, once more, about their illegal conduct.  This time a man answered, and he began yelling before I was able to do much more than state the problem.  One of us (I don’t recall whom) terminated this conversation shortly thereafter.  Not long after this, a man called on behalf of Clover’s and angrily dared me to come out onto my lawn, where he claimed he was standing at that very moment.  Fortunately, this person was actually speaking to my answering machine, and so we have retained a recording of his threatening statements.

Although I called the local police service to report the threat and the blocking of our driveway, no police ever showed up.  I did, at the dispatcher’s request, call when the truck finally left to let the police know that they didn’t have to send anyone; I feel, however, that the police should be immediately sending someone in any situation where a threat can be proven (or is even suspected).  I couldn’t even walk onto my front lawn this afternoon and evening because the Springfield Police Department refused to stop the misconduct of Clover’s Lawn and Landscaping.

The work that caused so much noise pollution, the illegal parking that caused a problem with passage on one of Springfield’s major residential streets, and the making of a serious threat to a disabled person were perpetrated by Clover’s Lawn and Landscaping of Billings, Missouri for persons at 1946 S. Newton Ave. - a residence, according to city records - that is owned by one Dan Simpson.

- Please notice the dates of reports.  The original report comes first; my message containing addenda to that report is last.  Clover’s rebuttal has been placed in the middle of the two.  I’m not sure where this refutation of the rebuttal will appear, making the dates very important in following the dialogue.

- I have retained physical evidence of all my points in the form of digital photographs, sound recordings, video, and statements from witnesses.  I can prove everything I’ve said, and I’m prepared to do so in a court of law if Clover’s refuses to stop harassing me.

- I can prove that my report is legitimate with physical evidence, while the Clover’s representative cannot prove that I’m lying.  This means that Clover’s rebuttal constitutes an act of libel, yet another criminal offense.  I feel it’s extremely inappropriate to support one set of crimes with another crime.

- Representative of Clover's, leave my soul out of it.  You’re a landscaping business, not a church.  And you’re certainly not in a position to judge moral character.

THE ONLY THING THAT IS TRUE ABOUT THIS STATEMENT IS, WE DID BLOCK HIS DRIVEWAY. I FEEL SORRY FOR HIS SOUL, SPREADING SUCH VILE AND UNTRUTHS ABOUT A COMPANY. PEOPLE WHO KNOW US, KNOW THIS IS NOT TRUE. PEOPLE WHO DONT KNOW US, KNOW WHEN THEY MEET US, KNOW ITS NOT TRUE. ENOUGH SAID.

I would like to add two items to my previous review of Clover's Lawn and Landscaping.

We contacted the offices of the city of Springfield today and discovered that Clover's Lawn and Landscaping was working in our neighborhood without at least one of the proper permits. Because their representative told me, in a phone call I recorded, that they definitely had the proper permits, they have also decided to engage in fraud.
