Countrywide Home Loans is the servicer of our home loan and for a company that is sooo good to it's customers, didn't notify us for 2.5mos.

When they did, it was by phone. They wanted to know "Why haven't you been paying us?". I replied that I didn't know who they were and why should I pay them anything? The rep. told me that they were servicing our mortgage and they were going to foreclose on us.

After some questions, I found out that they were sending the statements to our old rental address. The reps. response was that that wasn't their fault and we should have paid them anyway. Huh? How am I to pay them when I have no idea who to pay. Our previous servicer told us that they were no longer going to do so, Not to send any more payments, and that the new servicer would contact us.

So began our troubles with Countrywide.

We aranged to make a double payment when our Taxes came in Jan.

We were told that this would be Ok. We sent the check with the proof of our property Taxes being paid and though that everything was Ok. Little did we know that they held our check for over 2 weeks even though they had processed it for deposit and then their collection department contacted us. They were now forclosing on us and had sent the check back.

Everything we've done with them has been over the phone. They have not sent any of the notices that they said they would except from their Lawyer notifing us that we were in foreclosure.

We went through their workout department and paid and extra $800. over four months to appease them. They called us on Friday, Jul. 31, and told us that they were changing the due date of our payment to the first of the month and that if we didn't make our Aug. payment by closing on Mon. that we would be put back into foreclosure.

Now, we called the State Financial department and get them involved. The foreclosure is stopped until they can get all the facts and Countrywide has to respond.

Their response is that none of this is still their fault, and then the respondent proceeds to fabricate a list of Seven Lies and distortions of the facts, indicating why they are not responsible and that this is our fault and they are justified is stealing our home.

Do Not belive that Countrywide is an ethical company. I have personally visisted with a Lawyer and two Foreclosure specialists, and they all get the majority of their business from dealing with Lawsuits and people needing help in dealing with Countrywide.

There needs to be a Law protecting home buyers from the blood sucking parasites of Countrywide who are unethical, immoral,and only care to make money from those they abuse.

Do not listen to the Paid Lackey's of Countrywide who try to protect their name. They get their money sending innocents to this depraved company, and the more they send to them the more they get back. All at the cost of the home buyer.

1. If Countrywide puts "Return Service Requested" on their envelopes (and they do), then the post office won't forward the mail, it is sent back to the original sender with the new address. 2. I agree that the OP was at fault for not putting the house payment into a savings account (perhaps an interest bearing one) until they would be contacted by the new servicing company. 3. However, Countrywide has a long list of people who have had to sue them to stop forclosures (and Countrywide loses). 4. Finally, never do anything via phone that you don't record. Use faxes and emails. You can record a conversation provided that you notify the other person of the recording unless it is within your own state.

I have a few simple questions for you that I believe any reasonable person would like to know the answers to. If you or any other reader believes these questions are not reasonable, please say so. 1. "didn't notify us for 2.5mos." During this period of time did you take the money that was your regular house payment and save it for the eventuality of paying SOME COMPANY a total amount due when you found out who was servicing your mortgage? You didn't spend the money on something else, right? 2. "We aranged to make a double payment when our Taxes came in Jan." Why couldn't you just stroke them a check for the full amount due? You had been saving the money for your normal house payment right? 3. "I found out that they were sending the statements to our old rental address. " You didn't have a forwarding order with your post office? A reasonable person would believe that this is a prudent, responsible action. It never ceases to amaze me when I see posts like this. Sure...I agree that Countrywide could have called you earlier. Maybe it was their mistake to send the statement to the old rental address. But....YOU are the person who owes the money. I guarantee you that the previous servicer would have been able to provide you with Countrywide's name before that 2.5 months was up. Personally, I would have been on the phone with the previous servicer every other day and scaling higher up the chain of command until I got the correct answer. Now...a suggestion for you. Countrywide has a very good website at which you can view all of your account details, taxes, insurance, last payment received, next payment due, etc. In my experience, electronic (ACH) transfers directly from your bank account will prevent any misunderstandings about payment receipts. I am not a Countrywide shill. I am a responsible homeowner who is proactive with my finances.
