I Purchased a car in October 2010 I had set the payment to come directly out of my bank account on the first of each month because I am a Veteran living on a disability and I pay my bills in order of priority. Car and rent, insurance and groceries ect ect. down the line. The first payment was not withdrawn until the 6 of December.  I callled and spoke to a agent and corrected the problem and thought it was fixed. For 3 months my payment did not come from my direct deposit on the first. it was taken out when there was no money in my account and processed 4 to 5 times in a month. I call and speak to a agent where the calls are supposedly recorded, and I'm told that notes are being made and documentated on my account. I speak to another agent 3 days later nothing has been documened or It has been documented inproperly so it can't be found by the agent. My car was reposessed in May because I had fell too far behind on payments, when I had spoke to numerous CSA's specifying each time that I need the payment removed from my account on the 1st.

I finally got my car back after paying the late payments, service fees and every other ridculous fee possible. I called Credit Acceptance again, to make sure that they understood my situation that I need the money removed on the first of every month. I was told that I have a balance of 75.00 that needed to be paid. I paid it after deliberating on if it was worth the hassle (They can't get into computer screens unless the payment is processed now. Good tactic!) And I was finally rudely told that there was nothing that they could do, and I needed to contact my bank and get them on the phone to fix it because its not their problem that the payment is taken out on the 4th, or the 6th it's my banks fault. After I get that set up after numerous calls between the bank and the auto lender, less than a week later I begin receiveing phone calls from Credit Acceptance letting me know that I was one payment behind, because the computer doesent recognize my payment being set up on the 30th as for the month that is upcoming it recognizes it as the previous months payment. So I'm one month behind on my payment again!! and I have a reposession!! (when I was told by a agent that it would not go onto my report because I paid within 60 days to get my car back!!!) And I'm being harassed daily with 2-3 calls a day from people that don't have the slightest grasp on the english language, sound bored, or threaten that "the calls will continue untill the late payment is paid." (What's the use of recording the call?)

I understand that the economy is bad, and they definitely understand that my need for transportation is dire, or they wouldn't shake me down for a payment on something almost every month. I hadn't had a car in about 2 years because my parents gave me their car to drive. But, if I knew then what I know now, I would have gotten another car immediately through U.S. Bank instead of having to deal with this second rate company and their band of not so merry thugs.

You want them to remove it on the first, but they don't take it out your payment until between the 4th-6th when you have no money in the account.  They are taking the money out AFTER you want.  So the only way you would have no money in the account is if you spent the money that was supposed to go to CAC on other items.  This is NOT the fault of anybody but YOU.  

My guess is that you do not use a written register and are relying on the the bank to tell you when you are out of money rather than keeping a register.  Because of this you "think" you have more money in the account you spend that money.  So when they process their payment the money that should have been allocated to them is gone.   Do we really have to wonder why you are with a Sub-Prime lender?

The solution is real simple.  Keep a written register.  Where every transaction you make you write down.  If you do this you would know that the car payment was gone(even though it hasn't been cashed), and not spend that money.  This way it wouldn't matter if they waited 4 days or 4 weeks, that money is still there for them to withdraw.

You have a bank account...you have internet service.  Why don't you make the payment on line on the date you set up with them?
