My 2001 Ford Mustang was towed on 4-14-06 @ 6:05PM by Cupertino Towing. When I arrived to pick up my car at the storage yard on Monday and after paying the total cost of $405 to get my car out I noticed the damage to the driver side skirt. Cupertino towing had obviously damaged it and I notified one of the storage yard employees (Danny) He agreed with me and took pictures and gave me Cupertino towing's number. I called and Craig Baker said he would speak to the driver who was off on Monday and get back to me on Tuesday. He never called so I left a message on Tuesday. Craig called me back Wednesday morning telling me that they will not accept liability for the damage they caused my car! He argued with me for about two minutes and hung up on me. My car driver's side skirt was pulled out by the front wheel and cut and scraped deeply which I have pictures to prove. The rest of my car is flawless and I just want my car repaired and Cupertino towing to pay for their poor business ethics.

If you contact the police or your insurance company, the first thing that will be asked is, "Did you SEE them damage your car?" If the answer is "no," it's pretty much over. Your deductible is probrably as much as the new part, and the insurance may not pay for it, as it's a six year old car anyways. The tower doesn't have to prove he didn't do it, and the yard-men are just employees and will say whatever will get you off their back. Means nothing, They probrably get a hundred damage complaints a day, about 99% of them false. I don't want to trivialize your damage, but cars are "supposed" to have 4 inches clearance, plastic scratches when a stinger is shoved underneath to the wheels, and stuff happens. It's a fast-moving business and there just isn't that much sympathy for one driver out of millions. I'm sure they didn't do the damage on purpose, it just comes with the territory. At least your car wasn't accidentally sent to the shredder. Yes, I've seen it.
