Having known Tristan Joya for over 4 years, and having been basically satisfied with a kitchen remodel his company did for me, when he approached me to work for him in May, 2014, as a design consultant, I said yes, under these terms:  I would set appointments and meet with clients to select tile and granite once they had signed a contract.  The agreement included traveling to Cave Creek from Tempe, to pick Mr. Joya up, and take him to sales appointments.  In return for this, he promised to use his crews to do some repairs on my home, and I would only pay for materials used.  I put over 3000 miles on my car, and he gave me gas money in the total of $200.00 over the next 7 months.  His tile people put up one 14' row of tile above my kitchen counter.  I provided the tile, adhesive and grout.  

While traveling all over Maricopa County, I listened and advised him about all the problems he was having with his sales people that included them taking his leads and giving them to another company.  

I am an honest person and have owned several businesses in the past.  When one young salesperson died and the others quit, I volunteered to work also as a sales person and we agreed to a commission of 6%, although it was never in writing.  I took over three large contracts that had not been started, at his request.  

DaVinci Green AZ has a computer program called Market Sharp.  It does everything, including copying the proposal and mailing it out to the client.  It also keeps track of progress on the job.  I could never get that program to work from my home, in spite of the fact that I called Market Sharp on several occasions to seek help in resolving the problem of not being able to attach the proposal to the program and send it to the client.  It was then decided I would do EVERYTHING except attach it, would email it to the office and they would attach and click on two buttons and send it.  The woman working in the office did not send out or delayed by days or weeks sending out my proposals.  By the time they got to the potential client, they had made arrangements with another contractor.  Adding to the delay, was the fact that I had no experience in building contract estimating and when I asked Mr. Joya for help, his usual answer was "I don't know."  These were questions about pricing that were not on the Quote Sheet.  They included moving a sink to the other side of the room, removing a wall, or moving a wall to name just a few.

Of the clients he gave me because everyone had quit or died, one involved me spending everyday that the workers were in her home close to Paradise Valley, supervising the job.  When a question arose, I called and/or texted Mr. Joya for answers as I had not been involved in this line of work in the past although my background includes art.  He became more agitated as time past and wouldn't communicate with me.  The owner was furious with him.  Numerous items were not done correctly, including making the pantry door opening so small that a regular door would not fit in.  And if they would have made a custom door, it would not have opened because the refrigerator was sticking out.  If we would have had good drawings for the contractor to follow, instead of Mr. Joya telling the client to "just tell the workers where you want things" perhaps the pantry would have been built properly.  I have numerous emails and texts to substantiate my statements.  I went out of town for a death in the family on the Wednesday before Thanksgiving on Thursday, November, 2014.  The workers were not at the job site from Wednesday to the following Monday.  He claims I didn't do the job and mistakes were made because I wasn't there for 3 weeks.  Simply stated, "NOT TRUE".  It was after January 1, 2015 before the job was finished.  I continued to be there when workers were in the house. It was then that they all started talking about wondering if they would be paid and that I should also be concerned.  His live in girlfriend at the time had told me that I should get EVERYTHING in writing. I didn't do it, thinking he was a "friend".  When the job was finally finished, I went to the office for my check, and he refused to sign it.

At the same time, another job that was handed over to me was not going well before I ever took over.  The workers left a big mess, and the client called and asked me to come to her home and document the mess, which I did.  I reported back to Mr. Joya,  who really didn't want to hear about how his new framer and dry waller had left such a mess, including splashes of plaster on the cabinets.  About one week later, Mr. Joya asked me to go out there again and check on a new guy he had hired and report to him the quality of work.  At the same time, I was to pick up some paper work that Mr. Joya had sent out to the house with the new worker for the client to sign.  The new employee lost the paper work.  The owner then told me the shower head was in the wrong place and she would not sign off on the financing papers stating the job was finished until Mr. Joya agreed to move the shower head.  I called him and he was furious, yelling and swearing at me because the other person had lost the papers and he didn't like the fact that I reported the new person wasn't doing a professional job.  He finally agreed to a letter stating that if the owner signed off on the financing, he would move the shower head.  She reluctantly agreed.  I have a copy of the letter in my files.  I had to go back out to Gilbert on Sunday at 9:00 PM to pick up the signed papers and take them to Cave Creek first thing Monday morning so DaVinci Green AZ could be paid for the job because the financing commitment was expiring that evening.

In both cases he refused to pay me. He claims I did not do anything he told me to do.  I also know that there are others who did not get paid.  I have a video of Tristan Joya yelling and swearing at me when I asked for payment on February 15, 2015.  He claims if he ever has any money he will pay me.  I do not believe he has any intentions of ever paying me or the subs.
