First Dell attempted to charge me $99 for "free" shipping as advertised on tv. Then Dell failed to deliver the computer. I later received a phone message notifying me that I could call to cancel the order as a result of Dell's failure to meet its own delivery date. When I called to cancel the order, I was told I would receive a check for $99 within five days in order to refund me the $99 for "free" and delayed shipping. Dell never provided the $99 refund it claimed I'd receive for being charged for "free" and delayed shipping. Additionally, Dell never provided any rebate forms, as already addressed by other duped consumers on Rip-off Report.com. However, these consumer rip off issues combined paled in comparison to the ultimate rip off Dell had in store for me.

Dell's televion advertisements should let the potential customer know, "Dude, You're Getting Defrauded." The supposedly brand spanking new computer Dell finally got around to sending me was (and continues to be) DEFECTIVE, USED, AND PREVIOUSLY RETURNED BY AT LEAST ONE OTHER CUSTOMER BEFORE DELL SHIPPED IT TO ME.

Right out of the box, the Dell computer repeatedly and intermittently shut down. In response to this information, Dell first responded that it had probably failed to install a number of necessary files and/or numerous files were corrupted. Next, Dell informed me the hard drive was bad.

Additionally, the computer froze up constantly.

I discovered numerous files, including numerous music downloads, from at least one previous customer on the computer Dell had sold to me as "new" and never as "reconditioned" or just plain "returned and sent out to the next unsuspecting person duped by Dell."

Dell's most recent response to my insistances that Dell take the computer back and issue me a full refund - as would obviously be appropriate to any ethically run organization - was that if I didn't like the files from the previous customer(s) on on my falsely advertised "new" computer, I should just delete them!

I have contacted Dell over and over again repeatedly, day after day, week after week reporting the information contained in this Rip Off Report. I repeatedly insisted that Dell take back the defective and used computer previously returned by an earlier party that it had sold to me fraudulently as "new."

I have additionally and repeatedly requested the assistance of any Dell customer service manager and Dell has repeatedly refused to permit me to communicate with any such person, should any such person actually exist in the Dell hierarchy.

Dell additionally demonstrated a bored and cavalier attitude when informed that Dell's actions had forced me to contact my District Attorney and the California Department of Consumer Affairs in order to request assistance, as if this was just any every day occurence and "business as usual" at Dell.

It seems that Dell's handling of this matter has extended beyond any innocent oversight that could have been easily remedied had Dell desired to do so. Instead, Dell has repeatedly demonstrated a blatant and insistent intent that I be forced by Dell to retain and pay full price for a brand new and fully functional computer Dell never provided, in spite of Dell's full knowledge that it provided me with a defective and used computer returned at least once by previous customers.

I am willing to work with any government and/or consumer group who can assist me in securing the appropriate return and full refund as a result of Dell duping and defrauding me with a defective, used, and computer previously returned by another party. I cannot help but wonder and worry how many other unsuspecting new and future customers Dell will dupe and defraud in this manner.
