To the 11th Circuit Court of Miami-Dade County:

We call for the disbarrment of Diane M. Van Ness, a Miami-Dade non-practicing attorney who poses as the consummate professional guardian ad litem, while she violates the statutes in the very field about which she teaches at University of Miami Law School.

"In a proceeding in which a lawyer guardian ad litem represents a child, he or she may file a written report and recommendation. The court shall not, however, admit the report and recommendation into evidence unless all parties stipulate the admission."

In Diane Van Ness' world, however, her reports are filed and, unethically, copies are sent to her judge "friends," without any notice, hearings or due process. One blogger said it well here: "She retains full control of her false child abuse stories." The minute you don't give into her financial demands, she files disturbing, falsified "horror stories" about you, as if they are the truth. You have no defense. Her reports are admitted, even though you never stipulated such admission. These unethical perjuries become part of the permanent record, as if they are "the truth."

"Reasonable visitation is the first option given to the non-custodial parent. It allows the two parents to create a flexible visitation plan that works in the best interest of all parties."

But not in Diane Van Ness' world. She does not allow the non-custodial parent to see the child, often for months or years at a time, unbeknownst to the judge. She reports to the judge that the non-existent visitations are "going smoothly" and that "the child is well-adjusted to the new situation."

She has a sociopathic disregard for the trauma she is causing the child, and the family unit as a whole. It is disturbing that she lectures at UM Law School, as if she is a healthy, seasoned, "powerful" professional.

We do believe that, eventually, in the proper time and context, her wrongdoings shall be revealed in front of her peers, including Judge Sandy Karlan, Judge Celeste Muir, Judge Ellen Sue Venzer, and other judges in the 11th Circuit Court. They will no longer judge her by her campaign donations toward their re-elections, or their "friendships" or superficial social communiques. Rather, they will see, in due time, that this fraud of a vile woman must be stopped.

We fully concur with all the other bloggers on this site, and are willing to provide extensive documentation.

Anybody who falsifies my healthy patient's medical records, in my name, at the cost of my license, or my patient's well-being, under sworn testimony in a court of law, should be disbarred. Period.


You have my vote. Get rid of this guardian ad litem.

Agreed. Disbar her. This woman incessantly states, "Pay me or you don't see your children." Even during the third of the year that she is away on vacation. Even when the parent does not owe. Even when the parent already has paid her. It goes on for years...

That's as sick as it gets, as she works in the field about which she clearly has the most clinical problems. She should not be allowed to come near families and children.

She will never admit this to judges or UM Law School, yet, continues to do so.

There must be a stop to this.

I agree. Count me in. It is time guardian ad litem Diane Van Ness be seen for what she is. An extortion artist.

Too many people have been destroyed by her. Disbar her!
