Sorry you didn't read the entire post but I purchased the car with 16,181 miles on it sooooo.. let's do the math.. 44,000 - 16,181= 28,000 est.... NOT 40,000!!!

My mother has a car that it 3 years old and she uses it for business, and she travels from NY to Kentucky, and NY to Maine, several times a year when I visited her at christmas she barely had over 50,000 miles on it. In 3 YEARS. (And yes she does other traveling even closer as well, she is only home for vacations, and the occasional week she actually works in her office. And she still drives that same car.) So for you to say that you put that many miles on it in one year for pleasure. Seems ludacris to me. (Also my husband his car for a year and then drove it cross country, (WA to NJ) and still didn't put 40,000 miles on it.)

This vechile is owned by two proud parents that work everyday and just go out on the weekends on long-distance trips... No Taxi nor Delivery here bud..

Just shy of 28,000 miles in one year is alot of miles in that part of the world. The vehicle would have had a 3 year or 36,000 mile warranty even if you had purchased it new, which you didn't. You could have purchased an extended warranty which you didn't. Do you use it as a delivery vehicle or a taxi? Or just take alot of trips. The reason I ask about the delivery/taxi is because you state 2nd and 3rd gear problems. As much as I hate car dealers, you didn't have a problem with them or their vehicle until after a year, in which you've put 28,000 miles on their vehicle.
