About 2 months ago I bought a dedicated server from www.directclanhosting.com for 610 English Pounds.

For that I will get Quad Core 2.4ghz, 4GB ramm, 500GB Sata/Raid.

With Linux, Xen, HyperVM on it.

They told us that it will take them 48 hours to get the server online in the UK.

After the payment It took them 3 weeks to get the server online.

After that we discoverd that we only had a 150GB Sata, not the 500GB we ordered. Also there was Windows Server 2003 installed on it and none of the VPS software we ordered.

Now 2 months later, we still didn't get the right harddrive and there is still Windows on the server. We can not use it for anything.

We emailed this webhost like twice a day and also spent 35 on calling the guy. We also asked for a refund twice, but he doesn't give refunds he says.

Yesterday we got an email from him, telling us that we had to pay an other 50 English pounds for the Co-Location.

We do not want to pay that.

Yesterday I sent him a reply giving him 3 chooses.

1. Rebuild/reinstall the server.

2. Give us a full refund.

3. He has the time untill June the first to do one of the above options or I start a lawsuit.

What can I do about that? Do you have any idea?

I their a legal way to get my money back without the use of a lawyer?

Oh, I paid through credit card.

I would say that this is fraud, we do not get any support what so ever.

First of all this person "Pekkel Oistewijk" is not even a customer of ours we have no record of him signing up in our billing system and i would like to see where he can prove he is a customer. I do however understand that he could be fighting for a customer of ours which had the problem but they were not understanding what so ever. They purchased the machine outright so when they paid it they owed the machine they also got a chance to check it out and accepted it. I was in the process of getting the hard drive upgraded and they said that was fine. After a month had gone by everything is there for them it was just the hard drive i was even happy to refund the difference on the hard drive to how much the 160GB it was. They never even called me for a start i have no records from there number in our system at all. I can provide proof of all this as well. I tried to reason with the customer many times and all i got in return was abuse over the interent and threats. I have found these posts and other posts on different forums most of which are classed as slander. I've contacted other forums and they have managed to take the posts down in our favour because we have not done anything wrong. Its been at least 4 months now and they haven't even botherd to get in touch until last month asking for the machine to be sent to them. I do have proof of logs on this so surely that the machine is fine and they are accepting that we are in the right? This surely puts the case a rest because they have asked for the server back so everything they have posted is wrong. About the calls and there expierence with us the customer used to rent a dedicated server off us before this and didn't have a problem at all.
