I have been selling on eBay for 11 years and haven't had any issues until recently. All I did was call eBay to ask if it would be okay if I opened a 2nd store and the representative I talked to told me she didn't see an issue with that. So I opened my 2nd store and I had to call to have another rep finish setting it up for me (don't know why, but that's what the site made me do).

When I finally got a hold of someone, she looked over my account and told me she didn't have a choice but to suspend me for life because I have other accounts open and with so many accounts it sends up a red flag as being a bad seller. I told her I didn't have any other accounts and she said they all have my name attached to them with my address. I assured her that they weren't mine, but she insisted that it was me.

I didn't do anything wrong, all I wanted to do was have one account to sell books under my main account and my 2nd store was going to be all brand new products. When I explained my plan she stood by her word and said that all of my accounts would be suspended indefinitely and in a rude voice she said I was welcome to try Amazon. I told her whatever, Amazon is more expensive than eBay, I got rude right back telling her thank you so much for ruining my extra income that I use to put food on the table for my family, which I will no longer be able to do. She apologized, but didn't seem real and I just told her to have a nice life and I'll see her in hell and I hung up.

A few days later I got an email that a dispute was opened up from a buyer. The buyer said she wanted a refund because she found a better price online. I told her she could get a refund if she sent the item back. I contacted eBay to make sure this was going to go smoothly and make sure I was going to be protected. When I got the item back, the buyer had actually sent me the same item, but it wasn't the one I sent her. She sent me the one she found somewhere else for a better price. I called eBay and explained to them about the situation and they said that buyers can't do that, but because I've been suspended, they have no choice but to refund the buyer and that I will have to try and sell the item I received to get the money back.

Since they refunded her, my PayPal account became -$45 and 2 days later I got a call from eBay demanding I pay them the $45 back. I told the guy that I didn't have the money because she sent me a different item than what I shipped out and she was refunded anyway. He asked for an explanation and when I was finished he told me he didn't see anything wrong with that. I told him that it was fraud and is against the law to return something that was never in your possession to get a refund. And it's equivelent to shopping on Target.com and finding a better price at Kmart.com and telling Target you want a refund and you purchase from Kmart.com and have it sent to Target.com. Not only would they refuse to refund you, but they would probably take you to court for fraud and everything else. He defended the buyer saying it was perfectly acceptable and I told him my lawyer would beg to differ.

Needless to say, I'm looking for a lawyer to file a lawsuit against the buyer along with ebay for emotional distress and other pain and suffering they have caused me.
