As residents and owners of condominiums purchased from Ed DeVries, we wish to bring to attention issues with the property that, to date, have been neither satisfactorily addressed nor rectified. The issues in question involve substandard soundproofing and water leaks within the dwellings. Sound transmission between dwellings, from conversations at normal tones and television and stereo broadcasting to sounds of bodily functions through bathroom vents and floors, as well as water leaks through building exterior bricks and windows, has made occupancy nearly unbearable.

Builder Ken VanDyke and original architect Chuck Posthumus, stated that four levels of soundproofing were submitted to developer Ed DeVries during the planning stages of project, but the most cost effective method was selected. Chuck Posthumus no longer has a relationship with DeVries Companies. Former DeVries condo owner Robert Nadeau, claims he expressed concerns over sound transmission to DeVries Companies and was told no complaints had been voiced. Robert Nadeau described the building as Section 8. When threatened with legal action, DeVries Companies was successful in concealing the problem confirmed by Cornerstone Architecture, with a Mutual Release and Settlement Agreement, signed by former DeVries condo owner Robert Evans. Agreement contained confidentiality and non-disparagement provisions. DeVries Companies knew about sound habitability issues, concealed it from purchasers, and refuses to fix another sound problem confirmed by the building's newly hired architect Tom Nemitz of Cornerstone Architecture. In September, DeVries Companies, Inc. turned over building management to Realico Inc.
