Hi,

My name is Derek **** of Texas. I am writing this as of December 30, 2007. On November 25, 2007, I received a phone call from this company, eLocal Listing, about my small business, Blue Collar Moving. They made the usual claims: they would help us see better search results, ending in more business for us. Sounds good, right?

About two weeks in, I wasn't seeing the results I was looking for, and, regardless of my reasons, consumers have rights, and I wanted to cancel my account. After 10 minutes or so of being hassled over the phone by a representative, she finally said they cancelled my account and I wouldn't be charged the $149.00 setup fee or monthly service fee of $99.00 (Total of $258). She went on to give me a cancellation number, which means nothing, and proceeded to assure me that the account was closed.

However, as of December 28, 2007, I find that my account has indeed been charged $258 for the services that the company assured me I wouldn't be. Did they think that everyone would just let a charge like that slide by? No big deal? Bad move, eLocal Listing.

I called the company back today, Sunday, Dec. 30, 2007, and got a message saying the company was closed for the holiday until Jan. 2, 2008. Therefore, I am giving the company until that date to contact me. I left them a message on their answering machine, and contacted them via email. If the company chooses to not contact me, I will file a lawsuit, and no, that is not a threat. I am close friends with a retired lawyer who is still active in doing pro bono work for consumers. She is a consumer advocate. There will be no problem in taking action, and action will begin on Jan. 20, 2008 if eLocal Listing fails to contact me and/or refund my money before or on the Jan. 2, 2008. In the event that the company DOES decide to skip the hassle of going to court and refunds my money promptly on or before said date, I will cease and desist my actions currently being taken through the internet, and the case will be dropped.

Anyone else who has been wronged and is interested in a class-action lawsuit against this company, or just wants to share experiences, feel free to give me a call or contact me by email. I am eager to talk. Also, anyone interested in taking this company to court outside of my suggested method should also feel free to contact me. I am looking to take this to the fullest extent of the law, and am extremely interested in doing so.

Also of note - any rebuttals made by the company, eLocal Listing, or any individuals or affiliates thereof, will be ignored. I have already seen what you have to say to claims like this. Anyhow, you'll be seeing a lot of me, so don't feel like you have to contact me with your pathetic, false excuses through this or any other website that I am currently writing on.

Update: Elocal listing resolves dispute

Updated as of Jan. 30, 2008 - Elocal listing resolved the dispute; money was refunded and account taken care of. What at first appeared to be dodgy business practices now appears to be under control. Sorry for the inconvenience, things are taken care of now. No further action is necessary. Derek
