I had a Providian Mastercard and made a payment ONE day late in the mail. Providian charged me $29 for the late payment and wanted to raise my rates after I called on the phone to complain.

Feeling I was being treated unfairly I wrote Providian a note with my next statement asking to cancel the card and to send me the total due. Providian responded by "selling or giving" my account to emerge Mastercard who sent me a balance due bill.

I opened a credit card account with my bank and transfered emerge`s balance to my bank`s card. My bank instructed me to also pay emerge Mastercard a payment to make sure my credit rating would not suffer while waiting on the electronic banking transactions.

I requested in writing that emerge return my over-payment. Since then I have recieved TWO monthly statements showing no balance. I have been on the phone 3 times and each time I was told a different date that the check was mailed. I was told it was mailed on April 5 and on April 11, but the last time I called (April 16) I was told it was to be mailed in the next day or two.

I would like my money back and I don`t feel that a $29 late fee would be out of line.
