Ok, here it goes. I had straightened out my issues with FairBanks. Thanks to getting a number from Michigan's Attorney General. It was to the office of the Vice president of the legal dept. in FairBanks. I apologize to everyone here for not getting this up sooner but so many other thing's in life came up. Also the long battle I had with FairBanks that I needed to step back from the war a little while. Anyway when I got an email this morning about doing the mass media thing from RipOff report. I decided to check out the new horror storie's and oh my god so many of them since I have placed my own story. The man I spoke to was Terriell Smith he was so kind and sympethetic about what had happened with his company. He told me to send him my Bank statement's by fax showing that the check they weren't suppose to cash caused me numerous NSF charges. It also made me get behind on my house payment again. That at the time I spoke to him we were 60 days late. Mr. Smith issued me a check for $260.00 and removed $300.00 and something in corperate advances and late fee's. He also agreed to wait until my taxes came to pay the 2 month's I owed. He also agreed to take the delinquencies off my credit report and apologized for what happened. He told me if I had anymore problem's with the collection's dept. I was to give him a call. I was also called later that week by Kim Waldron who more or less apologized for her rude behavior to me and she said now that Mr. Smith is involved that he had the power to set thing's straight. I have called FairBank's 2x since every thing happened and each time the customer rep.'s were helpful and friendly. But do not think that my guard is ever down. I will always have doubt's and I will always be leary and I make copies of everything. My husband and I are trying to refinance because we need a cheaper rate the economy is not so good and job's are bad in the area. We struggle every month to make the house payment being behind sometimes 2 weeks and as far as I know the delinquincies is still on my credit report because a mortgage company we are looking in to said it was still on there but the company asked if I had proof about what FairBanks said about my credit report and I do. So we faxed it and I haven't heard anything from yet from that company but my fingers are crossed. I was involved in the last media campaign back in Febuary. E mailed everyone on the list and also wrote to Jenny Jones, Oprah, Senator's even Jeb Bush president Bush's brother. I wrote to classaction.com, Johnnie Cochran, called local attorney's, called the HUD inspector general to file a complaint. Jeb Bush sent me an e mail he was fowarding my info to the comptroller, Johnnie Cochran's office declined to a classaction suite, classaction.com declined to a suite, HUD was suppose to call me back and never did. As far as the media my plea's for help for all of us were never answered, Senator's never answered, Oprah never answered, Jenny Jones never answered. I felt so powerless and small. I even contemplated my own accidental death so that with the insurance money my husband could pay the house off and my 3 children would keep the roof over their heads. I do realize that seemed drastic and was irrational but at the time I didn't know where the 5 of us would go. My oldest being in the Navy or it would have been 6 of us. Marsha Miller from the Attorney Generals office gave me the number to Mr. Smith god bless her. After all the other numbers she gave me he was the higher up. I am giving you his number and I pray for all of us but he was the one who helped me and maybe he will help all of you who are living in my nightmare. Although he is with FairBanks he was my allie that day and not the enemy. I hope this helps some if not all. Call him: Terriell Smith 1-801-293-2503 FairBanks legal dept. I was also told that FairBanks was working on changing the way they do business but from what I have read it doesen't seem that way. Oh before I forget even though FairBanks gave me some of my fee's back from all the NSF charges and I had late chareges on other things it didn't cover all but I felt something was better than nothing God Bless all of Us

Hi Kevin, I get on this sight almost every day now and every day I see someone else being victimized by these BASTARDS. I am trying very hard to get some one to listen to all of us. But we all need to complain to anyone who will listen. My last endeavor was a letter to Oprah with the web address to this sight. I have written to a law group, I am still waiting for a response if I don't hear anything by Friday I will be getting on my phone and calling them. I would appreciate everyone to do the same. I suggest to everyone to do the same and not to stop until someone listens to us. I want these people to suffer to the extent that they are no longer in business or have to file bankruptcy. I want them to wake up sweating that someone is going to take everything they worked for and see how it feels only none of us deserved this tourment but they do. And I swear here and now I will never shut up about this company no matter how long it takes until I see them wiped off the face of this earth so they can't hurt good hard working families anymore. I could understand if we were the one's at fault but you pay your mortgage and they still want more. Granted some of us get behind sometimes things happen. But even big companies get into financial trouble and they aren't put out into the street for thousands sometimes millions of dollars. Us little people who can't hire big corp. lawyers are the ones that suffer and if President Bush don't want to see his budget screwed up with hundreds of families homeless and applying for Social Services benefits our govt. better get on the ball and stop these Bastards who can't take care of their records right and get them the hell out of business. They just don't realize but its the little ants that keep the colony working not the big fat queen that sits on her duff and reaps the rewards.We are the people who make america work. So lets keep writing and lets keep calling anyone who will listen and defend us. No matter how discouraged I may get sometimes I just come back to this sight and read the new reports on F_ _ K Banks (excuse my french but I get so mad)that reading the new stories about other families going through the same crap just gets me mad all over again and I'm ready to do battle again. Good Luck Kevin and write to anyone who will listen. My next step is Johnnie Cochran maybe he will like a little publicity and would do something worth wild for the little people. You never know..

I cannot believe what I am reading. I thought that I was the only one out here going through all this crap. I am dumb-founded. If there are so many of us..... is their a way to bring a law suit against these people. I have read some of these articles and I am just shaking my head saying " yep..... they did that to me too ". Real quick note : My name is Kevin and I live in PA. My mortgage was also bought out. I didn't even know it until I got the bill and saw a new address on it. Everything that I read here has happened to me and I am still going through it. I am keeping up on my payments that their are no late fees or crap like that..... but now they are trying to get me with this forced insurance. I changed insurance carriers and their was no lapse in the insurance. I had my new agent fax the papers to them. I did not know that they did not get them. They never notified me. So a year later.... I see this thing on my bill.... so I call them up and they told me it was the insurance.... WELL after all that I went through I went ballistic on the phone..... I totally ripped on the lady. I went and wasted money on a lawyer and nothing happened. So I can simpathize with all of you who this has happened too. I am going to end this now as my blood pressure is rising and I would like to keep this e-mail clean. Sincerely,

I finally got a hold of Kim Waldron after playing phone tag for 2 weeks. She stated that her manager would not do anything about the NSF fees from them putting my check through again. She told me sometimes they will and sometimes they won't. I said to her how does that work either you don't or you do. One policy not should stick in September you didn't and Feb. you do. I told her now I will be late for my payment in March because I am out a little over $560.00 on returned check fees. Half my payment for March. My husband and I were just getting back on track and now I'm back where I started. They also have not posted the cashiers check and asked me if I put my loan number on it. I told her I am pretty d**n sure I did and if they sent a monthly statement or a coupon it would be together. She said again that is a courtious service and expect people to pay by their due date. I then said well you can tell by the name on the envelope or signature who's account the money goes to. She had no answer for that. I also beleive I put the check in a white envelope with everything written on it and then into the over night envelope. These people have me questioning my own sanity anymore. My children don't understand why I'm cross with them or that I am crying all the time. My health is being adversley affected having dreams of these people screwing me over again and again. I can't take much more. That job I took to pay these bastards off quicker well, they had me lifting 17 lb. metal parts for 8 hours and now both my arms have tendonitis and I am on a 2 lb. weight restriction. Guess I won't be getting hired in after my probationary period so that dream of paying Fairbanks off in 4 years has been shot down at least for now. I have written to my district represenative and sent another fax to the attorney generals office.I have been contacting Lawyers to see who will one to start a class action. I just know their not posting that check so that they can say I'm in default and try to foreclose on me again. I have given all those people I wrote to this web sight and hope they read it. I just don't know what more I can do. Did anyone hear back from the news campaign we all did? Because I sure didn't. I will try to keep the faith but I can't help but pose the question to God what did I do to deserve this? I'm tired of fighting and its getting the best of me. WON"T SOMEONE OUT THEIR LISTEN TO US? I also told them I was contacting my atttorney general again. I also told her I wished they would sell my loan to another company because they have made my life miserable and a nightmare.

I am sorry for your troubles with FairBanks to. I have a fax number you might try 1-801-270-7906 if it's not the same that you have. I have contacted my Attorney General again and the woman who is handling my complaint won't be in till Tuesday. I just can't function with all the stress. I don't understand why when so many people complain to all these agencies nothing gets done. I am so sick and tired of hard working people getting stomped on by this company because we can't afford to fight back and they know it. You go to people who are in a position to help you and its all red tape but yet we are the ones who are being robbed and possibly going to be homeless because we try to defend ourselves. If I were you though I would close that acct. and start another one and contact your attorney general in your state because they did rob you if you did not allow them to take that much it is illegal. They robbed you plain and simple. I also went to a sight today classaction.com. They let you ask a question to a lawyer and I am waiting for a response. My question was how to start a class action suit against a mortgage company and if you need money to start one. As soon as I get an answer I will post it here. Sooner or later someone will help us if we all keep filing complaints against Fairbanks to our Attorney Generals and higher up if need be. I was just starting to recover a little bit since my Bankruptcy and now I'm right back in the mud. I pray to god to help not only me but all of us who are continually being victimized by this company. They say that there is strength in numbers but I have yet to see that happen with all the numbers of people that have filed similar reports about Fairbanks. I hope that a class action suit does happen and that they go bankrupt and see what it feels like to be us. Good luck to you and let me know if that fax number works for you. Its the one I was given 2 days ago when I was told to proove that them cashing the check wiped my acct. out. I called twice today and no one returned my call. My bank took my husbands entire paycheck for NSF fee's 583.00 and told me I was still $62.00- I have to close my acct. but they won't let me until I pay the 62.00. I have $10.00 to my name so I guess I'm screwed. I do Thank you very much for your compassion. Its nice to know that there are some people in the world who still care for their fellow man. We have been involved with them for over a year now. We are on a forbearance plan and my husband, the trusting soul that he is, allowed them to take ONE payment from our bank account this month. Normally we send them Western Union, but for some reason my hubby decided to do it this way this month. Well, they weren't satisfied with the one payment my husband agreed to, they took TWO. That's right, almost $2,000 in one shot. Thank God we had just deposited our income tax refund and there was enough to cover it, but it left us short to pay our other monthly bills. Hon, I know that they say one thing and yet do another. It's happened to us over and over again. We are now about to start a fight over force placed hazard insurance. Our insurance lapsed 2 months ago, but last week we paid our premium IN FULL for another year. Our agent mailed them proof and my husband called Fairbanks to tell them it has been paid. Our agent tried to fax it to them, but Fairbanks fax number is not working and all my agent got when she tried to telephone them was a busy signal. I knwo EXACTLY what's going to happen too. The next payment we make, they are going to take it and apply it to overpriced, forced junk hazard insurance then claim we didn't make our payment. This has happened to us before when our loan was with Equicredit. No matter how many times we and our insurance company provided proof of insurance, they claimed they never recieved it even though it was faxed AND mailed to the number and addrees that THEY provided. Never let your guard down, not for a minute. I will keep you in my prayers. There has to be some light at the end of the tunnel. I hope to God there is!

Still here in my home Thank God but now I am bouncing checks thanks to FairBanks. FairBanks told me in November that " They do not send checks through twice that is their policy" That's how I almost lost my home because one person in September told me they would send the check through again and they didn't. They said they sent a demand of payment letter which I never got. Anyway to make a longer story shorter I sent a payment in of $ 780.00 in which I was also suppose to have $177.00 in a suspended acct. That I could use with my payment plus I sent a seperate check of $ 40.00 to corp. fees from paying the lawyers. I did all this at the advice of Kim Waldron and had it in writing what the 780.00 was for and the 40.00 etc. sent to the cashier in Utah. Well I was $3.00 short and for some reason my bank didn't let it go through so when I got the notification from my bank Iimmediately my husband went and got a money order for the $780.00 and sent it overnight express which cost me $13.65 I sent it directly to the cashier in Utah 2/2/03. They should have gotten it 2/3/03. Yesterday I got notification from my bank I had several NSF checks 20.00 fee for each check I didn't know what was going on. I had my husband go to the bank and get me a list of recent activity well not to my suprise Fairbanks policy changed since September because they sent that check through a second time. So they got a the $780.00 money order for the check that didn't clear plus they got the $780.00 from my check. I spoke to Kim Waldron and told her what was going on she said she's not showing that they got a moneyorder posted. She had also stated " She didn't know what was wrong with the cashiering dept. that they were slow." I also spoke to her last Friday because I got a demand letter on 2/01/03 saying I owed for January and Febuary. I also told her I start a new job on that Monday which was Febuary 10 th and that we would be a little late with Feb. Payment and she was gonna look into my acct. because I had allot paid on principal and that I could probably apply some to my Feb. payment so I could pay less this month and keep current. I told her that we would be fine come March. She said she would get back with me on Monday or Tuessday and I never heard from her so I kept leaving her messages). I told I called FairBanks right away and talked to a man who said did I know my payment is $ 958.00 and not $780.00. Well that was all I had to pay for January but yet he said they didn't get January's payment. He didn't know anything about anything. When I called Kim and told her that they put the check through and I paid by money order she got snippy and said that I need to make my mortgage payment my number one priority and I do but sometimes I do have to put food in my 3 childrens mouths and send my son in the Navy a lousy Birthday card. I didn't think a $ 1.50 Hallmark card would make my house payment. I apologize to all reading this if I seem to be jumping around in my story but I am so tired and upset. I am now 470.00 negative in my checking acct. Because Fairbanks got paid twice by the time my husband gets his paycheck it will go on bounced check fees and I have no idea how I will feed my kids next week or put gas in my vehicle to get to work. Kim did say to send her proof that it was the check the sent through twice that caused my checks to bounce that she will see what she can do so I had my bank fax her that info. but I'm not holding my breath she didn't sound as if she felt that Fairbanks was at fault for getting a double payment. I want all to know that I have been looking for work for quite some time my husband is a truck driver for auto parts and had been laid off for 3 weeks between Nov. Dec. and January. We are responsible people. I was only going to get a part time job so that I could still be home with my children one who is 12 and is a behavoral child and another who is 13 who has trouble learning. Well thanks to Fairbanks I went and got a full time job so I can pay my house off in 4 years instead of the 8 years I still owe because I have to get out from these people who are making my life hell my 17 year old is still in High school and works at Meijers on the weekends and plays varisity football and other sports so I can't depend on him to watch the 12 year old I am also resposible for my retarted brother who does not live with me but I am his payee I pay his bills and take him to Doctors and I am his voice when needed.My husband leaves for work at 2:30 pm and gets home anywhere between 1 to 3 am.I get up at 4:30 am he's a sleep I get home at 3:00 pm he's already left for work I haven't had a conversation or seen my husband except when he is asleep for the last 3 days. I am transferring to 3rd shift soon so that I can work and still try to be a mom, a wife and a sister. My family and I are truly in for some hard times as a family thanks to Fairbanks because I am determined to pay this mortgage off sooner and maybe then I will be able to sleep at night and not worry about these bloodsuckers trying to pull our family and home apart. Who know's I might even be sitting in jail over those bum checks, I'll owe that to Fairbanks to. I guess if I look on the bright side at least I have a job I could get work release. I can't wait to see the fee's of returned checks from the places I paid by check what are those at least $15 to $25 each? lovely I won't have March's house payment either after paying all that out. Well enough said I need to get my weary bones to bed 4:30 am comes pretty early and I just got my kids to bed. I wanted to give all of you readers an update on my situation. As stated earlier in my report I was waiting on a fax from Fairbanks collection dept. with the amount due to stop foreclosure proceedings so that I might foward it to my husbands 401k emergency fund. I had called them on Tuesday and a Romando said his manager was faxing it to me that very day.
When I awoke on the morning of the 20th still no fax. I called again and they said they were waiting on the attorneys to send them the list of fees incurred. I told the girl I would call the Attorneys office myself and ask them to get a rush on it since I only had a 2 week dead line to pay up. When I reached the attorneys office I proceeded to tell the young lady that I didn't know if she was a secretary or a lawyer she said she was neither.
I told her that I needed the fees to be sent to Fairbanks and that it was crucial it be done today since they told me yesterday they were sending the fax and today was a diffrent story. Well out of sheer panic I took the advice of one of the other misfourtunate people whom also has a story on here to tell.
I called the Michigan Attorney General and spoke with a very nice woman who was a consumer advocate. I explained the situation to her and I asked her if she was familiar with the Ripoff report web sight. She said indeed she was. She gave me a phone number and a name to contact at FairBanks corporate office. She told me to tell them I had gotten the number from the Michigan Office Financial Institution. I did so and I got a very nice woman on the phone.
I explained to her about not getting any letter prior to the Foreclosure letter from Trott & Trott. I told her that a fax with the figures was suppose to be faxed to me and I still had not recieved it. She told me that she needed to speak with her supervisor and would call me right back. She did indeed call me right back. She told me that they were putting a hold on the foreclosure and that she was faxing me the payoff numbers as soon as we hung up.I recieved the fax with in 1 minute.
She asked me how long I needed to get the funds and I expressed to her 2 weeks. She said ok and that I was to mail the check overnight directly to her as her supervisor did not give her another address to send it.
She was very sweet and helpful. I hope that this does indeed take care of this problem. As for everyone else out there if its not to late for you here is the contact information I got from my Attorney Generals Office, Christian Zarnedoe 904-722-7557, The young lady who called me back from this office was Kim Waldron 904-722-7701 10401 Deerwood Park Blvd. Jacksonville, FL, 32256. The first number is the one I called and got her answering machine.
The second number is the woman who called me back so be sure to call Christian Zarnedoe first as I am sure she is the big wig for that dept. I hope that this will help some if not all out there. I truly hope that this is the last time I ever have this problem with FairBanks but the doubt still lingers in my mind especially till I see it in writing that the foreclosure proceedings have stopped and I recieve a letter of Reinstatement. I will keep you all posted and let you know the outcome after we get the funds from my husbands 401k emergency relief and mail it to FairBanks.

I explained to her about not getting any letter prior to the Foreclosure letter from Trott & Trott. I told her that a fax with the figures was suppose to be faxed to me and I still had not recieved it. She told me that she needed to speak with her supervisor and would call me right back. She did indeed call me right back. She told me that they were putting a hold on the foreclosure and that she was faxing me the payoff numbers as soon as we hung up.I recieved the fax with in 1 minute.
She asked me how long I needed to get the funds and I expressed to her 2 weeks. She said ok and that I was to mail the check overnight directly to her as her supervisor did not give her another address to send it.
She was very sweet and helpful. I hope that this does indeed take care of this problem. As for everyone else out there if its not to late for you here is the contact information I got from my Attorney Generals Office, Christian Zarnedoe 904-722-7557, The young lady who called me back from this office was Kim Waldron 904-722-7701 10401 Deerwood Park Blvd. Jacksonville, FL, 32256. The first number is the one I called and got her answering machine.
The second number is the woman who called me back so be sure to call Christian Zarnedoe first as I am sure she is the big wig for that dept. I hope that this will help some if not all out there. I truly hope that this is the last time I ever have this problem with FairBanks but the doubt still lingers in my mind especially till I see it in writing that the foreclosure proceedings have stopped and I recieve a letter of Reinstatement. I will keep you all posted and let you know the outcome after we get the funds from my husbands 401k emergency relief and mail it to FairBanks.
