I have longed for the opportunity to voice an opinion about Fairbanks Capital Corp. After reading so many other complaints about this same company I can not believe they are still in business. I have just got off the phone with customer service about a fee I was charged under the "other column" in the section "Activity Since Last Statement".

It so happens that they supposedly performed a Broker Price Opinion on my home in July and the fee is just now showing on my December statement. They told me that because my loan was 30 days late, they sent someone to drive by my house to confirm someone was still living there. When I was out of work (2)yrs ago due to a back injury, my mortgage was (2) weeks from foreclosure due to none payment from my insurance company and no such fee was ever charged. Also, at the bottom of the statement I specically ask for the remainder of the amount I sent in to go to additional principal. They took their fee from that amount with no prior notice of even oweing a fee.

I have been receiving charges like this and late fees due to their slow processing of payments since the inception of my loan in 1998. At that time my mortgage company went by the name of Conti Mortgage. I'm tired of being ripped off and would love to be apart of any Class Action Suit filed against their unethical business practices.

Fairbanks Capital, Jacksonville, Fl, Trying to rip me off again

#20

Mon, December 16, 2002

Once again Fairbanks is trying to rip me off. I was sent a letter on 12 Oct 02 stating that,"By the time I received this letter my insurance should have been cancelled and that if I didn't respond to the letter with proof of insurance that insurance would be purchased for me". I called Fairbanks and ask them what was the purpose of the letter? They said they showed my insurance expiring on 12 Sept 02. I then called my insurance company to inquire why my insurance expired. My insurance company said,"My insurance was fine and that it had not expired". I called Fairbanks back and spoke with the insurance department and they said that I needed to send them proof and they provided the fax #. So, I called my insurance company back and ask them to fax a copy of my policy and to call me when it had been done and they did just that. Thinking it had been taken care of, I continued to get letters stating that insurance was going to be purchased for me. Finally I received a letter from Fairbanks that said,"they received my insurance information and that the insurance Fairbanks was going to purchase had been cancelled effective 12 Sep 02". Thinking that this mini nightmare was over I continued with my daily routine only to get a letter in the mail last week that said effective 1 Jan 02 my mortgage premium was being increased by $93.00 to pay for the insurance that Fairbanks had purchased for me. I called Fairbanks and was passed around different offices until finally being put through to the insurance department. I explained my case with all the letters that I had received, only to be told that they never received my insurance information and that I would have to send it again. I explained to the rep that the letter I received from Fairbanks said,"they received my insurance" and the rep said unless I sent in a copy of that letter and my policy that I would be charged the increase or responsible for the period of coverage up to the time I sent in my paperwork. I quoted the letters that I received from Fairbanks, one of which had a date of 14 Nov 02. That particular letter stated that I had 30 days from the time of the notice before coverage would be purchased. If that was so, then technically I wouldn't be responsible for any coverage until 14 Dec 02. I also told the rep that I was sick of their crap and that I did what was asked of me and it was now up to them to get what they said I didn't send them when I had proof that I did. The rep went on to tell me that my coverage was fine and it would take 72 hours to straighten things out.
