Fairbanks Capital Corporation/The Bank of New York/and representing Attorneys, Hughes, Watters & Askanase in Houston, Texas are rip offs. In April 2002 the above mortgage company bought our note, they stated we were late 1 payment after making a $1300.00 payment by telephone to their office and in September 2002 they returned our payment of $600 and said they could not accept the payment because it was late and we were in foreclosure. We had 4 days to file bankruptcy to keep our house, we had to hire an attorney and pay him $400 up front to file Chapter 13, 1 year later we owe $10,000.00 more on our mortgage, and they are demanding $64,965.29 at the rate of 11.20% per annum as of 8-15-2003, not including attorney fees. Our house is scheduled for auction on 12-22-03.

I spoke to an employee of Fairbanks Capital Corp and he proposed that if we paid $1000 down and paid $1300.00 a month for the next year we could keep our house. We just don't seem to be able to get ahead now, we have tried to refinance but no mortgage will even touch us because of our foreclosure.

to those out there that read this letter you must get a lawyer to fight for you because you are not going to to get anythig from the class action lawsuit only 200.00 dollars that,s it. i got an attorney and paid 3,500 dollars just to get my house back in less then 2weeks, because fairbanks was going to sell my house at the court on 4-2-004 so my attorney, wish i call god sent to me, stoped all procedeors, and now i have to move to my house this week end, hopefully cause of the weather and all,and the last time i saw attorney we talked about this class action cause i recived aletter too and i asked him what was i going to do with this letter and he said just send it to me and i well fill it out for you so i won,t be in the class because i,m sueing,and you can,t sue and get a class action at the same, this is why i,m writting this letter to all,this is what people don,t know,so get a lawyer that well fight for you even if you don,t have the money get it some how,if you lost your house because of fairbanks or are losing your house sue, you are better doing it this way.i also thought that i was getting a lot of money this way but i,m not,i hate to say this but ijust don,t want people to think that there going to get alot of money unless you get a lawyer,that,s the only way,and the reason i know this for sure is because my attor-is suing for 100,000,000.00 dollars through the state court for all victums,if you don,t know how to get a lawyer in your area just look for an attor-that deals with big corporation lawsuit and that has more than one partner in the firm,i,m with a firm out in clevland,ohio.well just thougth that i should all let you know and gilberto and diana sue them don,t let them get away,they thougth that they had my house,but didn,t,they think that because they gave me my house back that,s it all forgive and forget they put us in alot of stress and uprooted us and damages,by going bankrupt just to keep our house and turned out that we lost anyways thru these thiefs and medically? i,m a dibetic and my surger was as high as 300 or 240 at times so the stress can kill you.and it all started with a refinanced through fireland mortgage they put us in a high enterest rate my payments were 511.oo a month and now they are 787.oo a month and since i moved out now they want me to pay what i oue them to stay at my house so i,m telling my attorney why should i pay for the five months that i was,nt there i moved out on nov.1-oo3 and now it,s 3-25-oo4.i don,t know yet but we,ll see. what people don,t know is that if you let the house go and say oh" well i,ll let them have it ,they well come after you for the remaining bal.i lost a home before in 73"and the lender never came back to us ,it was fha loan.but i wouldn,t trust fairbanks for a minute they well, since there money hungry. well better close now good luck all.

PLEASE READ THIS: You must contact the Redress Program Administrator by calling 1-800-377-1287 to get a claim form mailed to you. I have just been sitting here waiting for a Class Action Lawsuit to take place thinking that since my loan was serviced by Fairbanks/Loan Servicing Center, that I was automatically entered into this lawsuit. NOT SO.....I was surfing the FTC web site and found this info.....you must call and get a form to fill out if you loan was serviced during the period from 01-01-99 thru 12-10-03, and you were charged late fees and/or default related fees., this form must be filled out, mailed and postmarked by APRIL 24, 2004. DO IT NOW FOLKS!!! We were sold to Fairbanks from Countrywide. They sent us our escrow check back after we thought the taxes had been paid. Afew months later we received a letter saying our account could not be escrowed - not enough equity? So Fairbanks is now "recouping" the money they paid out for 2 years worth of taxes. Our payment has jumped $500 a month. We fell behind and received our first demand letter. I made the payment, but am still behind. I would like to help with getting with the attorney general. they have added over !50 worth of fees we had to pay.

WHEN I received my forcloure letter , the name of a victim from Spring Branch was on it too . the attorneys that sent the notice wouldn't help me and said our name was on it by mistake . i DON'T KNOW IF YOU ARE THE SAME PEOPLE THAT WAS ON MY NOTICE .
