My husband and I own a home in Colorado financed by Fairbanks Capital. Fairbanks has recently notified us that they have notified their attorneys to start foreclosure proceedings.
Fairbanks has sent back 4 of our house payments with no reason given only that it wasn't enough. We tried to refinance to get out from under Fairbanks but because they have our payments reported so incorrectly on our credit reports AND they refused to give the new lender a payoff within the 72 hour timeframe, we were unable to go through with the new loan. We have been charged with late fees when the the check was sent in two weeks prior to the payment date and Fairbanks sat on the check until after the late date. We have been charged for drive-by appraisals, "suspended fees", attorneys fees for things we have no knowledge of, too many misapplied payments to count, lost payments, and now foreclosure.
We were told by a "paralegal" at Fairbanks that as long as there was a formal dispute with our account, no action would be taken. Another lie. We filed a formal dispute with Fairbanks in January 2004, the FTC in February 2004, the Attorney General in February 2004 and have not heard a word from a single office.
So far, the only option we have been told to pursue is Chapter 13. However, others on this site have said that even with court orders and Chapter 13 arrangements, Fairbanks still forecloses.
Are there any attorneys willing to deal with these criminals in Colorado we can contact? Our time is running out.
