On November 26, 2003 I entered into a contract with FibreTech West out of Mesa AZ at the time to repair my Fiberglass pool at a home I purchased in Tempe, AZ. The repair price was approximately $12,000 to complete. The company has since relocated to 200 COUNTYLINE COURT SUITE 2 OAKLAND Florida 34787 or 16449 COUNTY RD 455 MONTVERDE FL 34756 or 11614 Lake Katrina Cirlce, Clermont, Florida 34711. These are the three addresses listed for his business which holds a license under the names Fibre Tech West / ELEGANT POOL DESIGN AND CONSTRUCTION INC, / FIBRE TECH OF CENTRAL FLORIDA. All entities are owned by Hugh Taylor Lynch.

The Project started in December 2003 with the company asking me to empty my pool and sending over ?TECHS? to empty my pool. In 24 hours the pool was emptied and it took 2 weeks to start work. The project was presented as finished on April 1, 2004 and papers for the warranty were signed off by both parties. Now this was not a pool that had to be constructed from scratch. The pool needed extensive scraping to remove old loose fiberglass from a previous repair by another repair company. The extensive sanding and demo could have been done in a week with a good ?FULLTIME? crew. This demolition took over 3.5 weeks to prep. And the entire length of the project took over 4 months to complete.

In mid May of 2004 1 month after the pool was supposedly completed I noticed Blistering was occurring below the waterline and the ?Top Coat? that was used to paint the coping was not setting. It remained tacky for one month after it was applied. I was told that this epoxy resin would set up in a ?reasonable? period of time. In December of 2004 my pool was again drained to fix the blistering problem and to sand the fantastic new texture of my coping.

As promised Fibre Tech send it's Top Technician Sergio who had done all the previous work to repair the problems during the first week in January. I was told this was an easy fix and would only take a few days. With rain delays and additional hold ups the fix was complete around April 20, 2005.

At the conclusion of this years pool season the coping on the pool has started to crack and the Top Coating inside the pool is starting to blister again.

Now I must admit, Hugh Lynch who was the previous owner of Fiber Tech West Inc. was always willing to help out and get things fixed. About six weeks ago I started writing Hugh letters telling him about the cracking and blistering. I wanted to have repairs made soon so I could convert to a salt water system. I had talked to Hugh some weeks ago about it and he said a lot of people like salt systems. I did not hear anything back from Hugh so I called in today 9/20/2005 at 11:40 am to speak with him. The office manager Gail advised me that Hugh no longer owned Fiber Tech West Inc. I asked what I should do about my warranty problems. She said she did not know what I would have to do but I would have to work it out with the new owner ROBERT MICHAEL CORDS. The new name is Fiber Tech West a division of BACKYARD TRANSFORMATIONS INC. I spoke to Myra at noon PDT at the corporate headquarters in Largo, FL. She asked me to fax her my contracts and she would have the new owner call me. Robert Cords the new FibreTech West owner and I talked at length at about 2 PM and he explained there were many problems he was aware of and he did not know, as of yet how these problems would be addressed. I informed Robert that I had my pool repaired by Hugh and he had given me a new written Warranty extending the period two more years since it had to be repaired a second time. That would make the warranty valid until April 2007. He said he would be willing to do small repairs on small areas but not larger scale projects like mine. That would have to be worked out with Mr. Lynch. I asked if he had heard anything from Myra in the home office in Key Largo since I took the time to call her long distance and fax over my past contracts. He stated that he had not heard anything

After trying to contact Mr. Lynch with no success I had to contact the Arizona Registrar of Contractors. I sent them all my pictures and emails. They contacted Hugh and that got him to finally call me. Hugh was supposed to show up for an inspection of the problems caused by his product or labor malfunctions on 10/27/05 at 1:30 pm. He could not make it so it was rescheduled to 11/17/05 at 1:30pm. Mr. Ron Lamp Inspector for the Arizona Registrar of Contractors and myself were in attendance but neither Hugh or his representative showed. Hugh contracted with a gentleman by the name of Julio Saenz to do the repair work. Julio started the job on the 19th of December and completed on January 9, 2006. Touch ups were completed on Monday January 16, 2006. I sent a letter to Hugh on January 4, 2006 requesting three things before I would sign off on the pool repair.

Here is a verbatim copy of the email:

Hugh,

There are 3 things that I need to settle with you before I sign off.

1) since this pool has not been right from the get go due to bad product and labor you need to extend my warranty another 2 years under Fibretechs warranty. This warranty needs to be one that Bob Cord will also honor if there is a problem.

2) since I have had to have you re-do the pool three times I have had to pay to fill it 3 times, this is the fourth. I think it is only fair that you pay the 30 bucks to fill it this time.

3) You need to provide the start up chemicals again.

In the name of fairness this is only right. I still don't understand why it takes so long for you to answer emails and not let me have your phone number. The feeling I get from this is, now is that you are gone from here that you wish all your problems with product would go away and you are too busy there to really deal with a mess that was left in my backyard to begin with. I hope that this repair is final and we can put this all behind us.

As of now January 19, 2006 I still have not heard from Mr. Lynch. My pool still is empty because he has not provided start up chemicals. I have asked the subcontractor Julio Saenz if he has talked to Hugh and he keeps telling me that Hugh does not call him back. All I want is what I have stated above.

From what I know Hugh Lynch has started up a FibreTech Franchise in Florida. He is operating out of Clermont Florida. All the above is fact. If you would like copies of emails and pictures of my pool, that are state records here in Arizona I will send them but please send $8.00 to cover postage and printing costs. The package is close to 50 pages. I don't have to say anything negative about the product or Mr. Lynch, basically he is a nice man but I let the product and truth speak for itself.

As a side note, Julio Saenz, the person who Hugh sent to do the repair was a very hardworking individual who treated me better that any of the workers I had in the past. He paid strict attention to detail, showed up on time and I had hoped the materials he was provided would last in my pool.

May 24th, 2006. The pool had been empty a long time so I decided to fill the pool up. I still had not received word as to who will be paying for the startup chemicals so I paid for them and added them myself. I will have to incur all the costs of this pool start up. I was told that it would cost $$$ to own a pool but I never thought I would have to pay so many times for other peoples mistakes. If I had it to do all over again I would have filled in this hole in my backyard and saved myself the aggravation. I would never recommend this vendor.

A New Chapter

I was contacted by Hugh Lynch on 8/4/2006 and sent this email

Jeff,

I will be in the Phoenix area this coming Monday and would like to look at your pool. If possible, Monday afternoon would be good, say around 3:30 or 4 pm.

Please confirm that the gate will be open.

Hugh as promised came out with his lovely wife and looked at my pool. He saw the problems I had and said he would look into the problems. All he did was take pictures but did not take samples of the blisters or water. He said that the pool would probably need to be stripped, new fiberglass applied and recoated. Since I have an extended warranty issued by him good until April 2007 I figured he would take care of the problem as usual and try to make it right once and for all. Mind you the pool has not ever been right since the first application back in April 2004. Since the most resent application by Julio on January 16, 2006 and conversion to a salt pool the material used is bubbling like always and in addition I am developing strange black areas that I have been told is Cobalt. I was hopeful after Hughes visit but I later got a note from Hugh stating that he had consulted the Chemists at Fibre Tech Inc. and he advised me that there was nothing else they could do. He basically was saying thank you for your money but Fibre Tech will no longer fix your pool. He later came back and said that he would supply product which we have ascertained was faulty and not applied properly from the beginning, but I would now have to pay for the labor of a re application this next time.

I started contacting Hugh Lynch on October 2, 2006 about getting my pool fixed hopefully for the last time.

He finally responded to me on October 16, 2006 and here is a copy of his email response.

Jeff,

Sorry about the delay but my email and internet has had a serious problem for some time now.

As far as your repair work is concerned, all work is to be scheduled through the new dealer in Phoenix, which is Kenny Aceves. He is doing business as Backyard Transformations dba Fibre Tech West.

According to his arrangement with Fibre Tech Inc. in Largo, FL he is to handle warranty repairs, however, he will charge for the labor to install the product. Frankly, I question the wisdom of doing the pool again. The last time that the job was done I believe that Julio was very careful and thorough to insure that the job was the best possible. You yourself reported that he did a good job and that you felt that it was a material problem. I know that Fibre Tech has had chemists evaluate the blistering phenomenon and have also tested the substance under the blisters and have been unable to come to a conclusion as to why the blisters are appearing later. The only thing that I can think of is that there is some type of reaction with chemicals that are in the original fiberglass pool structure that is causing the problem.

According to the Registrar of Contractors my license has been cancelled and has been for about 15 months now. According to them I am not permitted to either do or contract for any remedial work. The company paid to have the pool re-worked earlier this year and there is no money in the corporation to pay again. The corporation has no assets and has had no income since early July 2005.

Fibre Tech Inc. has indicated their willingness to supply the materials to do the pool again,. and perhaps you would feel better contracting with Julio to do the job again if you decide that is the way that you want to go.

Can we get my repair scheduled in the near future? The Pool season is over. Can we maybe start OCT. 17 and work straight through, not taking 5 or 6 weeks as usual? Julio finished in 2 weeks. I am really upset that his work did not last. He seemed to do everything by the book and paid extreme attention to detail. I don't understand why we have had so many failures. What did corporate say? As of now everything is bubbled including the stairs. I would appreciate it if you stripped everything including the blue squares on the steps so you can re lay the matt without cutting holes in it.

That is wonderful, Hugh mentions above that it will cost me the labor to fix my pool that was never repaired correctly to begin with. Secondly He advises me " Frankly, I question the wisdom of doing the pool again". Sure he can come to that conclusion, It wasn't he that paid $12,000 hard earned dollars to have his pool worked on and the job was not right. HE GOT PAID!!!! Now he is telling me to pay again for something that may never be correct and his company said they could fix.

I finally took the matter to the Arizona Registrar Of Contractors. We had an Administrative hearing on November 20, 2006 in front of Administrative Law Judge Brian E. Smith at the State of Arizona Office of Administrative Hearings. Doc # 06F-M0698-ROC. The judges order recommended that "commencing on the effective date of the Registrar's Order entered in this matter, the Class KA-05 License be suspended until the Registrar of Contractors receives written proof the Respondent has either (1) remitted to Complainant as partial restitution the amount of 4,864.80 which is the sum attributable to the fiberglass under the parties' contract or (2) remitted to Complainant to retain such services of another licensed contractor to perform remedial work on the project's fiberglass and related coating."

"IT IS FURTHER RECOMMENDED that if Respondent provides to the Registrar of Contractors the written proof as above-required on or before the effective date of the Registrar's Order, the above license suspension shall not take place." The Document date was 12/27/2006

As of now no compensation has been made. I have estimates to do the job which start at $6,000. I have contacted Hugh Taylor Lynch. He was mailed the court verdict when mine was mailed 1/17/07. Here is a response to my email to Hugh Taylor Lynch. He sent this on 1/25/2007 at 7:28 PM
