Fifth Third Bank calls me nine times a day - from 6AM CST to 10PM, at odd hours, and frequently it is a machine.  Then, when I do get a person, they won't shut up long enough to hear anything I have to say.  After calling back to their call center three times, finally got through to someone that could talk to me, and they said that since my payment was due tomorrow, it was late (yeah, like that makes sense), and my previous months' payment was also late (when I remember clearly making a payment the previous month, and they also wanted next months payment right away.  They refused to accept any payment less than three months payments, plus fees of over $100 that they were doubling because the second payment would also be late - but it was due tomorrow. 

I kept telling these guys that I would go into a physical bank to talk to a physical person about the account and make a payment tomorrow, but they kept telling me that they were noting a 'refusal to pay' and we going to repossess my car unless three months payments and fees were made immediately.  

I will never do any business with Fifth Third ever again - and I have strongly recommended that everyone steer clear of them as well.

The person said that they made a payment the previous month. That means they are not late. The person also says they are a day before the due date, meaning they need to pay by the close of business on the due date, which in context is tomorrow. Even if the person is late, he or she should be treated with respect. Yes, there are laws protecting customers in the event that an account is past due. There is nothing wrong with the company trying to contact the customer. The laws to dictate what time a debt collector may or may not call. This person is being called 9 times a day. THe law says that the debt collector may not call to harass or to annoy the consumer. Calling nearly 9 times a day is harassment. Therefore, the debt collector can't do that.

You say that you had been getting calls starting at 6am until 10pm at night. How is that possible. Collections per FDCPA law can call from 8am until 9pm your time. Unless that is that you have a EST phone #. No one can be calling you at 6am not even the dialer. No one is in their offices at that time of morning. They can only call you once  per day (if you answer the phone) and as many times as they want as long they are getting your answering machine. What you can do is write a letter to the bank and have them to stop. Then they can send out letters to you letting you know what the next step in the process will be. Geesh imagine having to pay on a car loan. WOW, I'm impressed.They have a right ( if according to your state law) to repo your car for non payment. and paying it the day before does not cut it either. It takes up to 48 hours for payments to post and if you had been paying on your car as agreed upon you would of known that. Even if you pay it at the bank. Don't blame the banks for your stupidity. And why they wanted payments in advance, gee I wonder why. Cause you're late with one which means now you owe another so that equals two payments.If you think about collections calling at the wrong time of day. Read upon the FDCPA laws..state laws supercede . But no one can be calling you at 6am anytime due to no one is in the office at that time of day no matter what state you're in. Keep records of  who you talk to and what time of day. Keep records of any payments.But best of all pay on your car. That will stop the phone from ringing. Always works. Geesh, I purchased a new $28,000.00 5 yrs ago and my phone never rang once from my bank. Maybe it's because I paid on it each month like clockwork. Have it set up with the bank for auto payments taken out by ACH every month. That works too.

They insist you pay as YOU agreed when YOU signed the loan papers...how inordinately rude of them.

Why don't you sue them for harassment and let us know how that works out?

Heres a thought I'm sure hasn't even occured to you...why not pay a full payment every time and on time?

I'd bet your calls from them would stop.

They're certainly a most heartless bunch of bankers for attempting to get you to pay the money you owe them, and the car is the property of the bank until fully paid for.  They can repo it at ANY time without further notice.
