My husband and I financed a vehicle with Fifth Third Bank two years ago. We kept the car for 13 months and traded it before the next payment was due. The dealership payed off(as they usually do when you trade)the vehicle and has already resold it.

Recently we recieved a letter saying we still owe a payment on the car. I have a copy of every check we sent to them that was cashed by them for our 13 payments. We payed ALL of our payments and paid them on time.

We made a phone call to Fifth Third Bank and their answer to this so called bill "we owe" is as stated: "they made a mistake and gave us a credit for an extra payment that we did not make". They didn't catch the mistake they made until four months after we had already traded off the vehicle.

Now they are saying that WE should pay back the money that was the result of THEIR mistake. I DON'T THINK SO.

Bought and traded the wife a car last Sat. The way it is suppose to work is that you or the dealer is suppose to call the bank and get a 10 day pay off of the balance of the vehicle to be traded in. It will be figured into the price of the vehicle to be purchased. If they gave you or the dealer the figure to be payed off, that's their problem. Let them take you to small claims court and you can explain the situation to the judge. Especially since they made the error, if in fact they did. You might contact an attorney and have him write you a letter saying something to the effect that you acted in good faith and the bank is not. And, anything they do that might adversly effect your credit will be dealt with in a harsh manner, just to prove your serious and not to be taken lightly. I'd ask the car dealer what his experience is in the matters. Who knows, you might find he has an idea or two. It might be fair to do a three way split between the bank, the dealer and you. I'd get it in writting, with ALL parties signing off. They just might go for it to avoid the problems.
