I too have not had my check cashed for the payment due on June 26, 2003 on my Spiegel account. I have kept all of my statements for the last 3 years so I have lots of ammunition for a class action suit. This company just loves to post those payments one day late thereby assessing a late fee.

I too have an fcnb account via newport news and have paid on it and have never been late since 1995. My husband has a spiegel card with them also these payments were mailed on time in July, his was reported as paid but mine has not been posted. I cannot understand why they are doing this and how the Federal trades is allowing them to get away with this . What is odd is all of the other bills I sent out on the same day have posted to their accounts but this payment has not. I have good credit and was so stressed until I stayed up all night firing letters off and doing detective work on how to contact them. I tried the Bethpage N.Y. number and it is owned by Cardworks that processes credit card payments for some companies. I found out that card works took over for MBA, FCNB's credit card payments as of June 30th 2003, but my payment was mailed to Oregon at the address that they put on their mailing coupon June 25. My payment day was 07/07/03. If they are changing this should not be the consumers fault. Perhaps Cardworks, 708 Third Avenue, New York, New York, (212)986-9436 can give the consumer some leeway as to find out what is going on. Spiegel owns FCNB and they are not being up front with people about this. I am now firing off letters to all of the credit reporting agencies as I do not have any late pays and I dispute any claims of late pays for FCNB and I suggest any consumer in this situation do the same. I also suggest getting any consumer advocate involved. I do not know for sure if they will say this but I do not want to sit around and wait. I am also seeking to payoff part of the balance and transfer the rest and I suggest anone else to do the same. In the event of acivil action, keep all of your correspondence and proof of payments so that you can be a part of the litigation. I never thought this could happen to me as long as you pay your bills and pay them on time. A company that does something like this shakes the faith of consumers with all types of credit transaction, now I am checking and double checking all of my credit payment to be sure they are reported as being on time. I have all of my statements from the time I had this account and my husbands account but you can also use your credit reports to prove this too. I am sending copies to Liberman Ct. state's attorney general.

The new number is 516 576-8706. Automated response unit indicated last five payments through May, but not the June payment. However, also indicated the account was current! Go figure.
