As promised, here is an update on the Small Claims case for which I appeared today: Floor and Decor Outlets
doesn't suck nearly as much as they used to! I can say that because in Small Claims Court today, the two Denver-area managers appeared, and the magistrate sent us into a conference room to see if we could come to an agreement. And we did!
F&D agreed to credit me for the costs to date, including the floor purchase- in the form of store credit toward replacing the bad flooring- that's all I ever wanted from the start of this in 2009!
Also, the managers agreed to help me find a suitable hardwood solution to replace the engineered flooring in my house that is failing.
While I am saddened that it took a court filing to get here, they were very nice in the discussion today, called their headquarters and agreed to take care of the problem.
My suggestion: before you buy, ask a lot of questions. The sales person may not know the answers, or what to ask YOU, but if you stay vigilant and get all the info you can, you will be able to make a floor purchase that will live up to the 25- or 50- year warranty claims. And if you aren't finding what you want- try several other providers.
And be sure to check the BBB in your town as well. Apparently there was a mix-up in contact info for these stores- and that's why they haven't been responding to BBB complaints. I urged them to take care of that right away! No one want to shop at a store with less-than-A-ratings!

Although retailers will often help you file a claim, that doesn't mean they assume responsibility for a manufacturer's warranty. If you've got a written warranty from F & D for this floor I could see your point. You'd probably succeed in small claims as well.
My bet is that the warranty actually comes from the manufacturer. If they are really out of business, you may be out of luck. I know of no retailer that would assume a manufacturerer's warranty, especially one that went belly up.

I was told by the store that the manufacturer was responsible. The manufacturer's rep said to talk to the store. The store's corporate office initiated my claim internally- so that's where I am fighting!
By the way, the name brand of the flooring is GREENKETT and their website appears to no longer exist:

Why did you name the retailer and leave out the manufacturer. I don't think the retailer is responsible for a manufacturer's warranty, especially years after the sale. What am I missing?
