Due to a job layoff, I fell behind in my payments to Ford Motor Credit. Interestingly, they never sent any correspondence with regard to this matter to me ever. I live in Massachusetts where there are very strict consumer laws. When I was approximately 60 days past due, they began calling one of my brothers who I do not speak with (I found this out after the fact) and ruthlesslessly harassed him and my ill mother about the vehicle (neither party was a cosigner and I never used their address as a legal address either). They stated to both my mother and my brother that I was driving a "stolen car" and would be "arrested". They even began calling a party that happens to have the same name as me and harrassing her as well. They even sent a tow truck to my brother's residence.

I moved in October of 2003 and gave FMC (I looked at my info on their web site and they have/had my current address), my insurance company and the registry my new change of address. I never at any time "hid" the vehicle and was unaware they were trying to repossess the vehicle. In Massachusetts the finance company/bank must comply with a 21-day right to cure notice. I never received a right to cure notice. Needless to say, a tow truck driver showed up to repossess the vehicle, which was not given up willingly, and I was unable to retrieve my belongings from the vehicle.

I called FMC in attempt to locate the vehicle and find out the payoff amount as I was possible able to come up with the money. I received one phone call back with no message left and I then proceeded to send FMC a fax and a certified letter requesting payoff and vehicle location. I again received a phone call from FMC, no message left and definately no written response. In Massachusetts apparently the finance company/bank must send a written notice of right to redeem the vehicle within 20 days of the repossession as well. I never got one but.... 25 days after the vehicle was repossed, I got a letter from FMC stating the vehicle had been sold!

As I have retained a consumer attorney as I plan to go after FMC. I am just amazed at their blatant and illegal tactics and I hope no one else ever has to be subjected to what I have been subjected to.
