Fraud, Lies and Decemption.

Their insured sideswiped my vehicle. GEICO wouldn't take a look at my damage. I sued their insured.

Their isured filed a $5000.00 counter claim with absolutely no evidence/bases to support it.

There is a exchange of cleat coat from my Cadillac on her BMW right front rubber wheel opening molding at the exact measured height and horizontal plane as all the damage on my Cadillac. (I verified it yesterday on the exact same Silver 2006 BMW X3 3.0)
3) There is no damage, not even a hair line scratch on any where else on the left side of my Cadillac including the height of the damage the GEICO estimate claims to be from this accident.
4) Geico's insured BMW was seen on 3/25 /2016 5 months since the accident.
5) My Cadillac was seen on 12/2/2015 4 days later, right after Thanksgiving weekend.
6) I feel the culpability is probably joint and several.
7) The Counter Claim, Deductible & Court Filing Fee Geico's insured is claiming is Horse s**t!!
Bad faith, Deception, Unfair claims practices & fraud. 
My advice is stay as far away as possible.
The reason they have a Lizard in their ad, I think they are a bunch of snakes. in the grass!!!

With all motor vehicle accidents, it all comes down to one thing, Proof of Damages. The counterclaim may well be baseless, but it may have to be a court of law to disprove it.

Deductables are in all policies-they are not bull****!.  Read your policy.

Culpibility is 'joint and several'. You heard this one someplace, you probably don't even know what it means. It doesn't pertain to property damage cases.

Carriers do not pay for YOUR court expenses-again, read your policy.

1) GEICO has a list of complaints of Unfair Claims Practices on the Connecticut Department of Insurance website that will boggle anyones mind. 

2) GEICO wae sent a Certified RR USPS letter requesting they look at my vehicle. They never responded to it.

3) The accident occured on 11/28/2015 and they looked at and wrote an estimate on her vehicle 3/25/2016.

4) My vehicle was estimated on 12/2/2015

5) The pictures and damage estimate that she was paid for, was old damage from either one of 3 prior accidents with that     vehicle that are on record. Or another one that was never reported. 

6) The only damage on my vehicle is 28" from the ground. Her damage is at 42"  

7) Total damage to my vehicle is $5000.00 

8) I will go after GEICO for diminshed value of my vehicle when I collect on the damage!

9) GEICO Sucks!!!

Okay you have several things going on here, and while your entire report is basically on how bad GEICO is.  It seems as the only thing GEICO did(well didn't do) was see your vehicle.  You can not hold an entire company responsible for one of their insured suing you.  After all if that was the case, the other party could hold your insurance company responsible when you sued them.

But let's work backwards.  IF everything you have said about the counter-claim is 100% accurate, it seems very unlikely that the counter claim will go anywhere other than to get a good chuckle from the judge.  In fact, it may even be used to your advantage where if the judge thinks that the other party is trying to take advantage of the situation it may go toward the (lack of) creditibility for the other party and help you.

As for the original suit.  You stated that GEICO didn't see your car.  I have never heard of a company not even looking at a car, the issues always seem to be afterwards when they make their settlement offers.

Based on how you are describing the damage to the other car it really sounds like the accident was extreamly minor.  But a claim is a claim, so why did they refuse to see your car?  

How much are you suing the other party for?

What was the exact damage to your car?  Was there any police reports?  Did anyone receive a ticket?  Just trying to get a bigger picuture as there seems to be some things missing.
