I joined Golds Gym in Palm Beach Gardens, Florida in July/August. I joined because a buddy of mine had been a member there for several years and I wanted to have someone to train with, as well they had a day care facility and it would be good for our 19 month old son to be able to use as I was getting my wife to join after I did. I am glad she didn't get into this mess as well. Gold's Gym as it was known closed down and Pf Gym was now the new gym.

The owner was the same he just gave up the Golds Gym franchise and changed it to Pf Gym. Now I am no muscle head but the entire concept of the gym changed. No dumbell free weights over 60# and a ton of their weight training equipment went away. They wanted it to be a "judgement free" gym. I met with the owner and after about a half hour of negotiating, he finally said that he would cancel my contract that I had paid in full for 2 years and charge me a cancellation fee of 99 dollars and I would be refunded the remainder less the 28 days that I was a member. I finally figured I wasn't going to get anything else from him and told him to put it in writing which he did. He said that I would receive a check in a couple of weeks.

His arguement was that the corporate name was still the same and there was still a gym available. I reviewed the contract with him and mentioned that no where on the contract I signed was his corporate name just the name Gold's Gym. Needless to say I have visited the gym 4 times over the last 4 months and have yet to be able to talk to him again. Of course no check has been written either. I am going to take this to small claims court and with the contract and the letter he wrote stating he would refund what he said should be a slam dunk. It shouldn't have to come to this.

Six hundred dollars will not break me, but I am a man of principle and if someone says they are going to do something they should.

If I recall correctly, the FTC filed a lawsuit against Gold's Gym for just exactly that same thing. In fact, there actually may be a law in your state about this very thing. Get with a lawyer and find out. Usually the first consultation is free and if I am right, the lawyer can get his fees paid for by Gold's Gym.

Since you have it in writing from the owner that he will refund, go to small claims court and file a 93A action. (Unfair/Deceptive Business Practices). If you prevail, which you should, you are eligible for triple damages. Good luck.
