I joined as a member of Gold's Gym in Midland, Texas - this was in December 2006. When I joined, I specifically asked that I be on a month-to-month contract so that I could opt out of it at any time. I signed a contract that had absolutely no terms to it, other than the December 2005 date.

In June 2007 I went into the local location and signed a notice (30 day notice as per their requirements) that I no longer wanted to be a member of their gym. I noticed that they (ABC Financial) continued to draft from my credit card. I called ABC Financial numerous times and was notified that I had never cancelled my membership, and that no matter what I would have to comply with my two-year contract. Well, I did not remember signing a two-year contract, but, like most people, I did not know where my copy of the contract was, so I just went on letting them draft out of my card, because I assumed they were an ethical business and they knew what they were doing.

Low and behold, in December 2007, after numerous local conversations with the General Manager, who told me "tough luck buddy", and with ABC Financial, I found MY COPY of the contract! There were NO dates written on the contract!! I called the San Angelo TX headquarters and was told that their copy of the contract had a begin date of December 2005 and an End date of December 2007! I told them NO!

I faxed them my copy of the contract along with a statement asking them to refund all my fees that I had paid since I knew that someone else filling in terms to a contract is at LEAST unethical, if not illegal. They have refused to do anything about this matter. No one has called me back.

I just wonder how many consumers Gold's Gym does this to? How many of us get cheated out of our hard earned money by an unethical company like Gold's who fills in contract terms AFTER a member signs it!!!

I need some legal help with this! I would like to sue the hell out of this company and I would like to also represent the (probably) many consumers who have been illegally and unethically billed because someone filled in contract terms after they (the consumer) has signed.

With their complete arrogance, this is Gold Gym's Response to my original complaint to the Better Business Bureau: "While Mr. G... feels cheated out of his money heh failed to mention that he consistently used the facility during th epast wo years as members are required to scan their membership card when then captures a checking report I'd be more than happy to provide. Mr. G... paid for what he used. The cancellation policy has always been clearly stated on the membership agreement for he refers to as well. Gold's gym is not denying the fact his copy of the form was not complete. Mr. G...option would be to pay then the $10 per visit = $1860. He has paid $762 for his consistent use per the agreement. Furhter more correspondence to Mr. G... denying his original canel request was returned due to no accurate address info. " The FACT of the matter is that their OWN Cancellation Policy States: "Services under this contract are for the number of months listed herein" - THEY wrote in the months (two year agreement) on MY contract AFTER I signed and left. They breached this contract by unethically writing in DATES on a contract I had already agreed (ascended) to! It is breached because they MANUALLY altered the contract after I (the customer) left the gym! Of course I thought I was on a month-to-month contract. I was denied cancellation, not because I did not follow the procedures, but because they had MANUALLY altered my contract by placing terms (TWO YEAR TERM) on it after I had signed it and left. THEY breached this contract - not to mention TRUST. How arrogant can they be!? Is there no one out there who can help me represent the probably large number of customers who have been cheated out of money by Gold's Gym altering contracts by manually writing in terms to the contract AFTER customers have agreed to somethign differently? I hope there is someone out there who could help me with this breach of contract/trust case.
