We are in the Middle of a refinace and when we contacted Greentree to ask what our payoff balance is, they said it is 165000, 20,000 MORE THAN WHAT WE SHOULD OWE. We have been late a couple times but have always got current. Our original loan amount was through Conseco at $149635.30 6 YEARS AGO, our current statement says $145923.61. (We have paid $13,000 in interst a year, according to them on our tax statement.) THEN when we asked why, they said fees,insurnace ect. AND OUR INTEREST RATE IS 9.35% THIS IS BS. we have a fixed rate interst rate at 8.25% . Now we may not be able to refinace because the amount we owe is greater than what our appraisal value was at. HELP

However, since you have started with a lawyer, I would sue for damages and lost opportunities as well as all legal fees.... which is what you are probly intending to do. I wish it was a mistake, we called and also our mortgage broker(friend) called both got the same responce. And acually I got the APRs wrong we should be 8.49% and the new APR is 9.59% We now have a lawyer. They say 1. it is against the law for GREENTREE to raise our interest rate 2. the NOTE of Sale says there will be NO penalties or fees for early payoffs and we can payoff at any time 3. the interest rate is fixed 8.49% until paid off or end of loan which is 360 months. We also may loose the sale of 2 1/2 acres if this takes to long and that we will also sue for damages. We have also filed a complaint to The Washington State DEPT. of Financal Institutions. Next we will wait for more from the laywer and file with the ATTORNEY GENERAL.

And a monthly payment of $1089.26 plus escrow (if any)? So you called them on the telephone? I believe the advice others have given here about only communicating with a collection agency by certified mail, return receipt, is also valid here. I would not use the telephone. Request *in writing*, including all of your account identification, that they provide a *written statement* to you. Escrow is seperate from the balance, and it is not at all clear why you shold be quoted $165000. It is possible that the person you talked to simply looked up the wrong account. That can happen. Maybe you want to organize and present (all of) your numbers better. Also reread your contract to learn if they CAN change your interest rate for any reason.
